It does happen. My husband’s Outland application took three months pre-Covid. I suspect it would have taken longer from within Canada if we had gone that route, and it definitely would have taken longer if he had sponsored me for New Zealand and not the other way around.

Its all relative because every case is unique and every country has different rules. It’s not something that anyone can make a blanket statement about.

I think it should not take more than a month or two to get a decision letter if it was to be given by a IAD member (judge) only (not with the consent of the minister's counsel). If decision was made with the consent of minster's counsel , 2-3 weeks by email, faster.

If decision is with minister’s consent then IAD member has less digging to do with the consent based decision.
However , if minister’s counsel does not want to give a consent and is just acting as a block( based on her/his way of thinking) vs legal evidence and testimony contradicting to thinking of minister’s counsel , then judge has to clarify in written to make the right decision in appelant’s favour legally.
IAD member will not go by if this or that situation or some unbackedup negative perspective of minister’s counsel, they go by evidence / testimony that practically addresses the concern as per the blue book.

Is there anyone received the request letter after appeal allowed without medical exam request?
We received the request letter on Sep 13th. CPC Mississauga asked for criminal record, IMM0008, IMM5669 and biometric page of passport. But there is no request for medical exam. As I know before, they will ask for the medical exam together. Anyone here has the same situation?

Now the Visa offices have up to 4 months to send the blue book. Ours took about 3 to 4 months.
In our case the person looking at our case they felt CBSA would not go for ADR so as not waste everyone's time we are in the queue for we are waiting for a hearing date. We will have a half-day hearing. It is the waiting game once again.

I have a question. I heard if you lose an appeal does that mean you can never sponsor your spouse again, say if you re-apply? It does not sound right. Is this info incorrect?

1. No, you could sponsor the spouse again, as long you are able to overcome the reason for the refusal. If there is no new information or proof, you could probably expect another refusal.
2. I assume that you also lost at the Federal Court of appeal as well.

From my experience - its success rate is 50% , all depends on the mood of the other party.
To be successful in ADR (1 hr session) - you have to address the issues in a timely manner and be prepared for the questions with evidence .If in the end you still don’t get through with only reason being given is that other party wants to correlate the story with your spouse , you should get the message that you did your homework well and it was just that audience ( only one person) was not right enough to make the decision in entirety.
Preparation is the key.
