HI,

I am quite confused :-\ so i would just like to know more about the PR. Though i have read few info about spouse visa etc.


1) My girlfriend is gona apply for PR in Canada, and if she gets PR then can she marry me and then apply ME for dependant spouse visa?

2) How much time will it take for me to get a dependent visa after she gets PR and marries me?

MY gf is in india and i am also in india. My gf is applying for PR on the basis of Fedral Skilled Worker programme.

Why don't you get married first and then she can add you in with her application.

1: Yes but you will have to get married in India since there is 0% chance you will get granted a temporary resident visa (visitor visa) because they assume you don't have strong enough ties to India (your spouse being here in Canada).

2: The current processing time for spouse sponsorship in New Delhi is 2 months sponsor approval + 13 month PR approval=15months.
 
Best to ask in the skilled worker forum . You will get more of a correct response. I honestly don't know how the foreign worker application works.In family sponsor ship your girlfriend would have to include you in the application, if you have been living together for more than 1 year. otherwise it would be misrepresentation and she will never be able to sponsor you.

My answer:
Yes i am ready to get married in india. What i am saying is that after she gets PR in FSW can she marry me and then take me alongwith her to canda on dependant(spouse) visa???

She can sponsor you once she has her PR but you will probably be apart for many, many months.
 
No, if you get married after she becomes a pr she will not be able to immediately bring you with her to Canada as her dependent or spouse. As others have explained, she will have to sponsor you for pr. She can only do this while living in Canada.

There is a problem, the problem is if we want to get married then first we will have to go for a register marriage which takes more than 1 month time.
After that she needs to change her passport surnames to mine, now that also will take another 1 month.
Becz of all this, she feels that by the time she puts her file for PR, it will be late becz many caps might be filled in the FSW visa, and she won't have a chance to apply for PR.

This is the reason I am asking! If you can help me it would be much better.

Ok so to be clearer you have 2 options here, both of them implies spouse sponsorship.

1. You marry your gf fast enough in India, she comes to Canada and she sponsor you as spouse.

2. Shes comes to Canada, she goes back to India on vacation to marry with you, comes back to Canada and she sponsor you as spouse.

In both of those options, you will have to wait for an average of 15 months. As far as I know, you will never be considered as a depandant of her as her spouse. You cannot shortcut the system.

For spousal sponsorship, it's not required of her to bear your name on her passport. So unless it is required by your country or it's a cultural issue, you can skip this part.

There is no problem.

She can submit her PR application whenever it's ready. After you guys get married, she can then add you to her application. When she gets her new passport, she can simply send a photocopy to CIC to update them.

This is a FAR better option than her going through the FSW process, becoming a PR and the sponsoring you.
 
Under which category she is getting the PR? Is she just applying or about to receive PR?

It depends on the visa office. But probably 1-2 years.
 
if i will not going with my spouse in canda. have a any point increase in CRS in express entry
 
@legalfalcon Can you please suggest something for the below scenario:

1. The guy applied for the PR as an outland applicant via OINP and received PR visa but still has not done landing.

2. He married a girl in the same country who was also a PR applicant via OINP but hasn't received the PPR yet but most of her checks are completed

What should they do next so that their process also doesn't gets delayed due to additional requirements?

Your kind help will be highly appreciated.
