After negative appeal,,can you enter canada Ilegal?

Can my husband apply for H&C and still move from Canada till we get decision again!! He has his pr cart for 10years he didn't bother yo apply for passport!! Since he had hic pr for many years does he still has to be inside the country for any application in progress??

So many people do criminals and some how they forgive them!!

As already stated, you are required to be in Canada for an H&C app to be filed. Your husband cannot file for sponsorship while outside of Canada; it doesn't matter how long he has been a PR.

By your own admission, you committed misrepresentation, which is a crime.


As I said, your husband should move to your country. After living with you for a few years, he should return to Canada and submit an outland sponsorship app.

Thank guys!! It is much more easier to go to Canada on the right way!! But as Albaniens the don't give us viza!! My daughters are here and I was deported for misrepresentation as before I was a refugee in Canada!! CIC is not talking the marriage into consideration every time they bring up the past for me!! They believe marriage is real since they do not make many questions about it ,, but when they get the decision they say marriage is for status!! You dont qualify for H&C as you are not currently in canada.

Rest assured Flutra if you come to Canada illegally and get deported you can forget about ever having a chance to come to Canada through sponsorship. Right now you have a chance to correct yourself...its a long way but it is the right way. If you do something wrong again, your probably going to be barred for life.

I think the previous suggestion of your husband going to live with you in Albania for a while seems pretty reasonable.

That's what we are doing (and probably a lot more couples on here!). From the day I met my husband here in Guatemala, I have been living with him here. We visited Canada a couple of times (he has a TRV) but our home is here for now. It's been 2 years, and probably one more since we just sent it our PR application. I have had to sacrifice some things to be here with him, but that's what life is. I have had to put my career on hold, and our finances aren't the best, but at least we are together.

I obviously haven't been through the hardship you have, but try to think of other solutions before going the illegal way. It will not benefit you one bit in the end.

I understand you are desperate to join your family in Canada. You must follow legitimate path otherwise your illegal move may cause lifetime embargo to enter Canada. Have patience. Ask your husband to consult with a couple of good lawyers and go from there. I know how hard it is to stay away from your family! Life is not always fair. Have patience please.

He can most certainly move there. PRs can spend up to 3 years outside of Canada without any risk to their status.

He can not come to Abania because he was convention refugee!! Ang some where else is very hard to survive without jobs!!

Can he be outside of canada if we apply again because the only thing we can add up is to show them that he will be leaving with me until they get decision! To show them that marriage is real the only thing we can add up some thing different from the last application!! No hope that i can qualifie I was deported and no university only high scool & 0ne year secretary course in albania but the education here is not recognized enywhere!! O dear lord it looks like the doors are closed for me!! Thank you for your time!!
