After 36 months: I go for Mandamus! Who else here has hired a lawyer?

Well, you got what you wanted. They took action on your file. Now however, you are going to have to make a case to the CJ. Remember that if the decision is not favourable and you appeal to federal court--it will only be reviewed on the record--so it would behoove you to confer with legal counsel prior to the hearing. Of course, it seems hard to prepare for a hearing when it is not clear exactly what their issues are with your application.
You talk as if you are a very knowledgeable about the process, links18.
Where have got all this experience from?
Did you study law? Do you accompany your clients to hearings? Do or did you work for CIC?
Could you name any sources, which I could access to get some specific knowledge about the processes you are talking about?
Or are those just your thoughts and ideas, which you generate here?
Or maybe you have practically experienced the things you are talking about?
I would be interested to find confirmation for your interesting and pretty scary thoughts. Some links maybe?
Thank you.

Job Offer........
Pre-Assessed..

Wow, Msafiri, so many assumptions based on so many unanswered questions!
And such a pessimistic outlook!
"likely with recommendation for refusal" !
Scary!!!
How do you arrive аt your drastic conclusions without even knowing much about my case???
Cheer up!
As a certain Mr Holmes used to say there is nothing like first hand evidence - only you, CIC and the CJ have this no one else...we are feeding off the morsels you've given us...from inference based on the scraps we have such as your self employment, no details of pre PR/immediate post landing residence, no info on what was provided for RQ evidence and that you got an at test RQ i.e. CIC even at test interview had issues about your residence and that this was not a paper referral but a full hearing doesn't 'seem' like a slam dunk.

You asked the questions and you got the answers as best as possible. Nevertheless you could be/are right but I'd would like to hear your rationale as to CJ approval or even better that of your lawyer...we are all here to learn. Ultimately the outcome will be known in 19 days but to close if I may...I'm telling it as it is...if that makes it seem I'm not of good cheer then it is you making assumptions!

As I have said before, knowledge is power. If everyone responded with a generic, "Don't worry, guy. You'll sail through. No problem", then you would be none the wiser. Forum posters, for the most part, share their expertise in the hope that new ideas will spark new solutions. It may be hard to be on the receiving end when the answers aren't what we want to hear. These suggestions could help you prepare a strong case. They aren't sent as a personal attack. All the best.

Thank you Pippin for these harmonizing words. :)
I do not provide too many details of my case - as my intention was NOT to talk about specifics of my application.
HERE I wanted to ask about other people's experiences with hiring a lawyer and dealing with mandamus.

Hi, Msafiri.
Do not "feed off the morsels"... do not "infere based on the scraps". Be like Mr. Holmes!
And... cheer up! (this not not an assumption, it is a suggestion!) ;D

As others have said, we have no idea what the specifics of your case are. But the mere fact that CIC thinks a hearing is required means that concerns about your application remain. Or your mandamus application may have even moved CIC to refer to CJ without a full consideration of the evidence you provided in order to pass the buck.

You can find most of the information about the process by reading various sources such as CIC's operation manuals, bulletins, case law etc. Much of that is on the web.

All I can tell you, is that if I were in your shoes I would not go to the hearing without consulting and being represented by competent counsel. It may go just fine, if your evidence is strong or you could be in for a rough day. Thus it behooves you to be prepared. You don't have much time.

Sorry friend--too stressed myself at the moment to go and look. :-[

But do let us know how it goes. Maybe you will be the first one to post about a practical experience with a CJ.

Does anyone know if CIC will have a representative at this hearing or will it just be the applicant (and applicant's counsel) one on one with the judge?
