Hi we are new to the forum. We have been looking in to canadian immigration and have spoke to an agent on two occasions and got to the point where cash is needed to change hands but want to find more opinions before we go any further. My girlfriend of 5 years father was born in canada to a canadian mother and stayed there till he was 14 then moved to the uk. we have been advised that she can apply for citizenship due her fathers birth place and then sponsor myself to get a visa. simply we want to know if this is correct or are the agency trying to get cash out of us when they know that this route would be a no go and just take our cash. any thoughts welcome thanks

In theory, that plan would work.

If you have been living together for at least one full year, and have ample evidence, such as a joint lease, joint accounts (bank, cell phone, etc.), mail that has been addressed and delivered to each/both of you at the same address, etc., she can eventually apply to sponsor you as her Common-Law partner.

She will need to prove her intent to return to Canada (in the application) or she can simply return to Canada to start the process. You could come to Canada as a visitor, while your application is being processed, so long as you were not deemed inadmissible at the border. Having an active sponsorship application can certainly help.

The other option is for you both to come to Canada and then apply for sponsorship via an INLAND application. This would also give you authorization to work ~ 4 months after the application and Open Work Permit form had been received by CIC (Citizenship and Immigration Canada). The PROBLEM with the Inland application...is the ridiculous ~ 27 month processing time. The Inland applicant is advised to remain in Canada the entire time.


So...the big question now is:
Are you a Common-Law couple yet?
