Dear Seniors,

Would like to know if it is a problem to add spouse in family class after receipt of visa in FSW category in case the marriage was held before the visa issuance and spouse details were not updated.

In case its a problem request suggestions to tackle this situation.

Any material changes on the apps u r supposed to intimate your VO asap. Since the marriage was solemnized before the visa issuance u were required to inform about it prior to receiving your PRVs.

As of now, the wise action would be to surrender the PRVs, apply for including your spouse into your file, pay the fees & await further instructions from your CHC.

If u do not do so & "land" - u might face future complicacies.

Why do you say that I have to surrender my PRV for including spouse in Family class ? Is that the norm followed by CHC in this kind of case ?

Yes, that's the norm. The PRV is linked to your family composition, it changes - it requires fresh issuance.

Hi Derry,

I am a pre Feb 2008 applicant under the old rules.

Does this mean they will start evaluating my application from scratch and I have to qualify under present FSW rules

OR

Just that the present PRV is cancelled and after spouse visa is processed under family class both will be issued new visas ?

If marriage was held before the issuance of visa and spouse details were not updated, that is considered serious problem, the visa officer is going to put the applicant in strict proof to prove that marriage and going to ask a lot of questions. Concealment of important facts is considered as fraud and cheating. I remember someone landed in Canada and even at that time did disclose his martial status - unmarried and subsequently his sponsorship application was rejected on this ground.

Relax. There's nothing to worry. It's only a change of PRV -- no new process. Just that they'd process your dependent's file (wife, in your case), get her Meds & REISSUE the visa/s.

Yes, there'd be a delay, but that's about it. The delay is only in processing the wife's additional application, your own filing stands cleared.

Dear Explorer,

I have the following documents to prove the marriage was genuine:

a) Registered marriage certificate
b) Photographs of our marriage reception
c) Invitation Card of marriage reception
d) Rent agreement of house which I took just a week before the marriage.

Do you think with the above documents there would still be a problem ? If yes then what else should be done and how long should it take for my wife to get her visa.

Your documents are all right, but the problem is that you did not inform the visa office about your marriage and visa officers may take that matter serious concealment. They suspect marriages which are done during the process of application or after getting the visa. Even when you land in Canada and sponsor her they are going to find out ( from the date mentioned in marriage certificate ) that you married during the process of application and did not inform about the marriage. It is not like someone getting visa and them getting married and send documents to visa office and the visa office approves the application of spouse and grant her visa or a baby is born and the documents sent later on and visa granted. You can prove your marriage by the documents you have but how about the question : Why did not you inform about the marriage during the visa process? I hope you get some easy going visa officer who does not mind that and let you go through. I also think you need to consult a professional dealing in canadian immigration to chalk out a strategy or explanation.
