Hi,
I have a question about new law introduce from CIC about Citizenship and Immigration Canada Cracks Down on Marriage Fraud,
As part of its ongoing efforts to reduce marriage fraud in Canada, Citizenship and Immigration Canada (CIC) has introduced new legislation related to spousal sponsorship.

Certain sponsored spouses will now be required to live in a ‘legitimate relationship’ with their sponsor for two years after receiving Permanent Residency. If this is not adhered to, Permanent Residency status may be revoked. These measures apply to all applications received on or after October 25th, 2012.

The regulations apply to couples who have been in a relationship for two years or less and who share no children with their sponsor at the time they submit their application. Once Permanent Residency is received in Canada, the couple must continue their relationship for at least another two years.

my question is that if we born our baby during two years after our marriage so we will still have to wait for my Citizens ship as i am not apply now my PR case to CIC, i will be eligible in july 2013 because i am not living in my home country.

If you have a baby with your sponsor, this new rule does not apply to you.

This rule has nothing to do with how long it takes you to become a Canadian CITIZEN. The number of days you must remain in Canada to be eligible for citizenship is the same.

This new rule only affects whether you may lose your PR status, if the rule is broken. However, as I said above, this rule would not apply to you if you have a child with your sponsor.

Are you asking if you must have a baby during the first two years after getting PR? The answer is no.

It means that if you do not have any children at the time when you apply, the new rule applies to you. And, the new rule will only affect you if your marriage breaks up within two years after your PR is granted. If your marriage breaks up before you have had PR for two years, your PR could be revoked.

When the govt said ".......whose applications are received on or after October 25, 2012".. Do they mean when you submit your application to CIC? Or it starts counting when you submit to a Provincial Nominee Program? My best friend submitted to AINP Sep, 2012..Does her case apply to this new rule? Thx a lot!

When application is submitted to CIC.

I don't think the new rule applies to PNP though - I think it for family sponsorship, PNP is a different part - at least that's my understanding.
Could be wrong.
