My friend in Toronto,she is caregiver,she completed her 24 months and going to apply for PR+OPEN WP,but she has not good relation with her employer,her employer said her to ,they can send herback to her home country because they have their name on WP. Her employer has right to send her back in her home country?she can live apart from her employer.it can efect her status?

according to CIC once u completed your 24mths of the program u r eligible to apply for OWP/PR. So she can apply, n dont need an employer, n yes she can move out of her employers home, n no it would not affect her status

Her employer is crazy ! Ask your friend getting all her document from her stupid employer and leave.they have no right to send your friend to anywhere!if they keep doing that ,your friend has right to complain them!

I think normally she should give her employer 2weeks notice before she leaves ( my contract says at least 2 weeks ).so it is more professional if your friend can give her employer notice based on her contract

Aman, let your friend ask fr0m her employer politely all the necessary documents like t4, record of employment before she leave. It is d employers resp0nsibility to provide those documents.

I feel very bad when employers try to abuse their nannies,sorry for my acting ;D

She should tell them that they do not have the right to deport her and if they keep threatening her like that, she can complain about them to Service Canada and they will never get an LMO to hire another caregiver as long as they live. See how they like that.

She can quit her job. In an abusive situation, she would not be required to give notice. In order for her PR application to go forward, she must stay in the live-in caregiver program though so she should look for a new live-in caregiver job and get the new employer to apply for an LMO for her so she can apply for a new work permit. Once she has the new work permit, she can move in with the new employer and start working for them.

thanks for reply,i will tell her about her right's.everthing will be ok.According to me after completed 24 hour's ,we should have right to live or work anywhere.it's too hard to spend 2 year's @ same job

You don't have to stay in the same job for 2 years. You can change employers if you get a new LMO and new work permit.

The processing time for OWP is long and seems to be getting longer and I don't really know why that is. I assume it is because immigration does not consider this a high priority program or maybe they figure if you are willing to work 2 years to get PR, maybe you are willing to work 3.5 too.

Edit: Actually I just saw this bulletin: http://www.cic.gc.ca/english/resources/manuals/bulletins/2011/ob370.asp Seems like they will now issue OWP's to live-in caregivers without making them wait for first stage approval. Hopefully they will soon be faster than the 18 months they take at the moment.

Wow! It is a good news it was the same day that the minister announced and I will send my application in the middle of March I wish I would get it quick too! My friend is so lucky she sent it last Nov 2011 and got OPW within 3 weeks! I wish I wish iwish. !
