Thank you so very much kidvicious1. This whole process is very straneous. We have appeal the decision with evidence. The refusal letter said they are not satisfied we cohabited for 1yr before application. No reasons how they came to that conclusion. Here is our arguments : I lived alone from 2008 and my partner only moved in with me in dec of 2010. Meanwhile we didn't see any need to add his name on the lease as we wanted a bigger apt. We finally moved to another apt in September on 2011. We both signed the lease and currently living in this apt. We sent in our application february 24th of 2012.Our tax revenue for 2010 shows total family income as well as marital status. Not single but living common law. If we had been given the chance for a hearing or an interview we would have been able to explain why his name was not on the first lease.
My question is, will CBSA consider the fact that there is an appeal and don't start deportation proceedings? Can they wait for the result of the appeal because its totally an error?
Any advice from anyone will be really appreciated.
Thank you in advance.

Did you have any other documents that prove you where leaving together? Like phone bills with the same address or Hydro Quebec under both names? We moved together on April 2010 and since the lease was changed until June, 1st thing we did was to add my name on the Hydro Quebec, change my address on my mobile bill, credit cards, even Revenue Quebec, we sent copies of my bills and his bills under the same address and a letter explaining the "lease issue" since our landlord didn't wanted to give us a new lease only for 2 months! ... All this was on our application and until now they haven't ask us for any other documents.

That's the problem, my partner which is my sponsor has a very poor credit history. Hydro refused to have his name added to mine. Credit cards were refused as well. He wasn't approved for a monthly cell phone either so we finally transferred his prepaid line unto my monthly account early February of 2012. And cable bill is finally on his name too. When they requested additional evidence we sent them statutory declaration on common law union and then letters from friends that knows us and my work insurance showing my partner as the beneficiary. Our Canada and Quebec revenue showing our names and marital status too.
Anyone has Experience on how the appeal process and CBSA works?

I'm sorry to hear about your dilemma. I would advise to get letters from family and friends that know you live together, if they have come over for dinner with both of you, things like that, get them to write it in the letter. (personal accounts). Make sure you include their contact details so the cic can speak to them if they want. I got people to include their contact details in the letters written for me.

If you are ok with your landlord and your landlord knows you both live there. Ask them to write a letter! All it needs to say is your and your bf's name and the time you have lived at the address. you can even write it yourself and just get the landlord to sign it. THIS WOULD BE THE BEST EVIDENCE!!!

You and your bf, also could do with something like a bank statement for every month you lived together (as long as the 2 addresses match). I know for you it would be easy, Hydro, Bank, Cell Phone.
Did your bf/fiancee change the address with his bank? If so request bank statements to show the 12 months you lived together.

For your bf, you could also get a letter from his work, just say you need one to show how long he has worked for the company. Make sure they do it like a proper letter with your home address on. I know the time worked isn't important to the cic but the address is important. The reason I said ask for time worked is people ask for these type of letters often and work places have to do them.

Is there anything you can think of otherwise which your bf can use, anytype of memberships which has the address you both live? Examples, gym, costco, online accounts to shop etc. Anything you can think of where he has the address you both lived.

Any government issued cards, medicare card, driving licence. Take a photocopy, showing the address you both live. I'm the person being sponsored but I already have a Quebec Driving Licence. I've had it for about 1 year 2 months, I put a photocopy of the back and front showing the address when I got it and the address I live now.

BEST OF LUCK!

Thank you Vinlander! ;D

When we received the permission from CIC to move forward with MICC, their letter stated that the deadline for sending the CSQ was 01/29. Since our whole process was delayed due to their AOR letter getting lost in October, I emailed them to ask for an extension.

I received their answer this morning (strange coincidence!), and they recommend that we send them the CSQ as soon as we receive it, so we are mailing it to Vegreville today.

Thank you so very much. This is very helpful. We'll be going to our old apartment today to see the landlord and if possible some neighbors.

Congratz. YEAH YEAH ;D

Hopefully I could get mine in two weeks time, I took your advice to deliver by hand on Jan-24. A question, do we need to send the CSQ to CIC by mail? Or just because they mess up your timeline, you have to do this extra step? I remember I read somewhere, the MICC will notify CIC directly once the CSQ is issued.

If I were you, I would call CIC and ask them. That way, you will be covered.

Perhaps people who went through this before us will tell you differently, though.

Your welcome, hopefully you have been able to get somewhere with the landlord and neighbors. How did that go?

If you are struggling, try people like your bf's doctor, if you go to church - a pastor etc, police officer, dentists lawyers, professors, teachers. Basically anybody in an authoritative position which you can think of, either Where can confirm where you and your bf lived. If it is someone you don't know, just someone you go to see like a doctor, they could still give you a letter with the address on. I know some doctors charge a small fee to write the letter.

If the person in the authoritative position, you know personally, that would be perfect. Get them to give their write a letter with their job role, the dates when you lived together and get them to sign it.

I would still get neighbours to write letters as well though.

The reason I say get someone in a professional position, is the government always requires someone to sign official documents. They are seen as more truthful and trustworthy.

YOU DO NOT need to post CSQ, they let CIC know automatically, you will hear from CIC soon I hope :)

JG84 - How did you get driving license? I am British too but Quebec refuse to issue me one until I have PR card.
