2010 FSW CAP already MAXED!!? OH NO!!

Dear all,
I approached a canadian registered immigration consultant, regarding the new rules. I was interested in Restaurant Manager, and Business Consultants. I was told by the consultant that there is no point anymore to apply FSW, because he heard that some occupations are already CAPPED 1000 VISA, and that FSW is only still around as a symbolic gesture. Its sort of like H1B1 but 100 times worse. He also mentioned that Canada might revise rules but only after backlog is over which might take another 5 to 8 years (when we are all old and young life finished).

What do you guys think about this ? was it that this consultant just didn't want to bother ? I believed him because it made sense, since there are millions of people willing to apply, so i imagine 20,000 applications worldwide will obviously get filled within days, and occupation title is not issue as most people who apply anyway provide fake employment letter. IT Guy can get letter that he is plumber if the CEO is his friend, with fake experience proof.

I am very upset and depressed due to all this , especially since my home country is ravaged. I am well qualified points wise, but i was never able to apply because my employer wasn't ready to give me an employment letter with management position, so i missed on immigration to canada.

Please all those who say "BUT THERE IS PNP, AOE, etc"' , we all know that's extremely rare, as they all require job offer. And we all know STUDENT visa or visit gets 90% rejected unless you have your own realestate, or rich parents. ???

Thanks all for this great forum. I need your opinion, do you think there is still hope, or is 20,000 visa already capped and will be capped next year in few days (by the time you get all papers ready).

There are millions of applicants every year but much less than that make it through on FSW1 every year.
So you would have to see how many made it on FSW1 every year and compare that to 20000 total cap. Remember it is 20000 principle applicant not including family I think.

Jobs are capped at 1000 but I doubt 20000 is reached in less than 2 weeks because that would imply 520000 princple applicants per year, which sounds way too much.

Ya NOC system is for skilled workers only and excludes family, AEO and PNPs. I personally think that your consultant was trying to tell you that your particular NOC for Restuarant manager has capped the limit of 1000 but offcourse there must be spaces in other NOCs. I was wondering how would any consultant know about how many applications has been received by CIC. Even if the amount has been reached, that still doesn't means that everyone will qualify for next stage. I think it's still early, don't lose hope., try and apply ASAP as it won't harm you in any way.

The only way a consultant may know if someone applied and their application was returned because of the cap but its only been two weeks. I would think mail takes a week at least.

And I sincerely doubt that 1000 people had a complete application ready to go with experience letters, IELTs, and PCCs in less than a week.

Given the situational urgency that is there,A 1000 people worldwide to collect all the supporting documents within a week is a piece of cake.So do not overrule anything.Actually there is nothing impossible especially where there is a will.The words are ....IT'S POSSIBLE!!!

and they all applied in 5working days and the courier reached Canada the next day and CIC opened all their letters enter into their database and informed the consultants in one day.

Oh yes, all these 1000 people who did that were in the same NOC, without other NOCs slowing down the opening of the mail, etc.

I don't think the 20000 quo has been used out. But anyway, why don't you go ahead and send all your application stuff to CIO? Don't have the consultant's comments bother you too much. Consultants are not working at CIO, right? Even if the 20000 cap for 2010 has been filled, you still have a big chance in 2011 because all your stuff are ready to go, right?

Collecting and assembling all the docs within a week is possible but then the speed of movement of the docs as described is obviously unlikely.So the best thing is to overlook/overrule the consultant word and make move your documents.Actual word comes from the CIO...make your move.

He or she is just hassling you. Testing you. Observing your reaction "Oh, no, can you, dear consultant, somehow help me?", "Sure, for x thousands bucks".
Go to the OFFICIAL website, read it carefully and if you have your documents ready, apply.

I do no agree with the consultant. The reason is the list was out on 26th evening. 27 was sunday.
people started collecting documents on Monday. If in case they all dispatched all on Tuesday then also it needs atleast a week time to reach CIO. On what date you met your consultant

One might have all the documents in place but not PCC & IELTS which was not a mandate earlier. IELTS requies at least a month to get the certificate. I do not think in your NOC 1122, max number of people (1000 as cap) kept IELTS ready, knowing it was not in the earlier 38 NOC list.

What are you would be loosing if you apply and do not get. If you get it you are done. if do not get then also you have no feeling that you did not tried. Be optimistic and do it now before time finishes.

Thanks all for your wonderful replies. I am going to apply i guess on my own. i don't care about the fees. But till my papers are ready atleast 2 months in my case because alot of things are involved best case scenario. 99% chance 1000 cap will reach by then but i'll apply anyway for restaurant manager. And then if i use the SAME papers next year, probably they will delete the Restaurant managers from NOC :p.

I also agree with some of you who mentioned that maxing 1000 cap within 3 weeks is not impossible, as out of Millions, 1000 (per NOC) is very doable, because everyone is extremely desperate and some people can arrange documents very fast especially if they have connections.

Anyone else who is effected by this do let me know. Thanks for all positivity, it is the only way to stay alive and hope, despite the immense sadness, i will do my best to go on with life and always try.

And if anyone gets rejected due to Max cap limit do let us know, this way we can confirm.

Is the max cap pertained to a calendar year ? Any idea whether Max number is already acheived for current year ? Will it be a good idea to apply in the start of jan 2011 to get more chance of acceptance.
