2 Refusals - Need Help

Hi, I have received my second refusal today from the UAE office.

I applied for PGBA in Humber College and got a refusal on the first application. I had already applied for Masters and was waiting for the offer meanwhile, after the first refusal and obtaining my Masters admission, I applied for my second application for Fall 2021 intake and received a second refusal. same reasons as my first:
  • immigration status
  • family ties to country of residence (1 application shown return to UAE and second application shown return to India)
  • purpose of visit
I have applied for GCMS notes and will reapply again since i have started online classes for my Masters program. I wanted to seek your advise if I need to take help of a immigration lawyer or apply by myself again. for the third time (first application was through consultant)

To apply from home country is difficult as we have to establish ourselves first and then apply. SO confused. Please help.

Is the school a public or private school?

You don’t live in your home so how are you showing strong ties to India, career advancement (spending thousands in Canada so how much more will you make in India).

Purpose of visit can mean anything - few job opportunities, ties to home country, travel

A licensed consultant can’t change your profile.

That's why you were refused. You don't have established ties to your home country. How would they believe you will leave Canada when you have difficulty going to your home country?

What i meant by established in home country - is that to stay in the country for a month to apply only. I already have 4 properties and investments in India under my name - so financially and in terms of property & family I have enough home ties in the home country.

So you have family ties not properties to your country as that is a refusal reason. Your immediate family lives in India? Also property can be sold so what career advancement and job opportunities can you show in India. Are you attending a public university?

That's not proof that you'll leave Canada.

Home ties does not mean owning properties only, you must demonstrate your level of integration into the society where you belong, socially and economically. It can be demonstrated by having a career, a family and of course wealth.
So for example a young, single adult who is yet to start working and obviously has no significant savings and investments of his own will struggle to prove this, regardless of his parents and any real estate they may have passed on to him. Of course this is all relative and it's not as if such profiles don't get visas, it's how you argue your case along with dollops of luck

Are you saying anyone who want to travel to another country has to move to his/her home country in order to establish a strong tie ?

Yes, If you are applying for temporary stay in another country. You have to show that you will comply with the temporary stay regulations and will leave after your predetermined length of stay.
