She actually wants to use the Judicial review to buy time for her Express entry application. This means she cant even apply for the EE since she doesnt have the status. She thought the Judicial review will be a kind of implied status for her.

Has anyone applied for judicial review for visitor visa and restoration of status? What is the probability and how long does it take ? Also can a visitor apply for Express Entry while applying for Judicial Review ? Thanks L

By the sound,? I think its best to be sure of a situation before jumping in conclusions. He has a visiting visa, he can stay if he is legally allowed to .

Take this advice. Apply to sponsor them as dependent and also make them and appeal the rejection to buy you some time. CBSA wont come after them if there is an appeal in place. I dont know if H:&C will stop them . Apply to sponsor them asap!

Consultants are cheaper than lawyers. My lawyer was going to collect $3000 for reviewing my file. I mean just going through my already filled and packaged documents. I was too broke to give her the money so she couldn't check it .

Is your relationship complicated, with red flags ? If no and it's just a straight forward application, I'll advise you apply your self. Minimium $$ I have seen from an immigration consultant is $3000. If you are a straight forward couple (no ex, no previous marriage , no wide age gape etc. )...

I am hoping the deferral is approved just they can wait for you h&c application. If CBSA refuse the deferral please file in federal. I know it's taking a lit from you financially, posituve outcome will make it all worth it. Goodluck buddy.
