    100% an employer could post PHD (just saying) when designing job requirement. CIC will only see if it meet minimum job requirement from Human Resouce CIC.

    It could be reason for not accepting the LMIA application as job requirement need to be posted from HRSD. However your employer can describe either Masters or equal amount field experience. Its always better to check with Service Canada.

    It does ask for Prefered work status however you may write Implied status, restoration or Visitor visa. You could be back home and apply for LMIA as far as you are on legal status.

    Yes absolutely just create a EE and ask your employer for LMIA application and you prepare for Visitor ;D
