I am afraid your application will be terminated no matter what you do. Sorry for the disappointing news but it is better that You know the truth now than later. You could join the lawsuit which challenges the elimnation of pre 2008 files or better you could reapply in May 2013

Since you have already filed a case in the court, I am afraid there is nothing else you can do. You just have to wait like the rest of us, or you can reapply in 2013 when application door opens again.
