    Procedural Fairness Letter

Is it the case that you applied for a temporary resident visa (TRV) in January 2024, it was denied on January 30, 2024, and 3 days later you applied again, not admitting to the January refusal? I ask because, elsewhere you wrote: In the above message, you said "my arrival date should be...

Child benefit while living outside Canada

And that would be why I said, upthread: "As well, if you can depart for a couple of years and collect, then why not stay abroad and collect until the kids are adults? I doubt that's what the program intended."

Child benefit while living outside Canada

That's an interesting bit of info. I would have thought that the rent must be reported a tax paid on it and I would, until now, have thought that constituted paying taxes. I also thought that it would open the door to having to report and pay tax on worldwide income. If the rent is the total...

    Dependent Child Sponsorship -2023

I would say that if you have custody agreements them send them. But if, as in many cases, none exist, then don't worry about trying to create some. Send the form completed by the consenting parent.

Child benefit while living outside Canada

I asked because one precondition is filing and paying taxes in Canada. Not sure I know the final answer, but I must say I would doubt that Canada would pay for kids who are essentially non-resident. For one thing, I think it is structured to help pay the costs of kids growing up in Canada...

Will you have other sources in income while away from Canada, or the house rent only?

Unable to pay the overpayment of the payroll.

If you did not contact the employer, why the comment about "no response" from the employer? It sounds like you made contact, and you were ignored. Instead, it now seems that it took the employer awhile to realize the fact of the overpayment and to ask to you return it. "Assets" include...

    Need Candid Advice!

Your comment is a clear breach of @foodie69's intellectual property rights, a breach of copyright in particular. You have left yourself open to an action for damages for breach of copyright, including exemplary and punitive damages. The quantum of damages will only increase for each day the...

Unable to pay the overpayment of the payroll.

So, you realized there had been an overpayment when you left your job and you contacted the employer advising you had been overpaid by $935? Is that correct? And you also asked how it should be repaid. Is that correct? But the employer ignored your communications until payroll sent an...

    Dependent Child Sponsorship -2023

The poster did not say that, when they went to GCKey to look for a message, nothing was there, hence my comment. However, I will say, in the course of our own sponsorship/PR application and the application of another couple where I acted as rep, we never had that experience. Every time when we...

    Dependent Child Sponsorship -2023

That's quite a lively ghost, sending a message. I always thought a ghost update was something more ethereal. https://www.canadavisa.com/canada-immigration-discussion-board/threads/what-is-ghost-update.584367/ Why not just heed @charliem's advice and read the message? That will tell you...

    Connecting Flights

It looks like times have changed for the worse for Filipinos. In the years 1995 - 2002, I had a Filipino gf and she always travelled on a Phils passport. We flew Japan Airlines a few times, Vancouver-Manila return, and it used to involve an overnight in Tokyo. JAL would bus passengers to a...

    DNA

Very restrained answer there @armoured. I wish I could show your reserve. Me, I feel like shouting ARE YOU NUTS? Does the OP really think they can tell the IRCC what they are prepared to do and what they are not prepared to do, including refusing DNA request, and then the IRCC will come back...

Thank you for your post and link to what other lawyers have said, supporting my view that times have changed in BC and criminal charges are seldom seen in these cases anymore. A criminal conviction can be a real punishment and something to be avoid. It can impact matters such as employment...

Yes, the historic data I have to hand is up-to-date to last week. It shows, as it has for a long time, that drunk driving cases are not ending up in criminal courts at anywhere near the rate seen in years past.

I read about it there. It in no way derogates from my comments. Indeed, it reinforces them. Most of the discussion is about being handed a driving prohibition. The ones that I see in the case law are almost always of the 90-day variety. They are often contested on judicial review. Forgive...

Very sure. The link goes to a BC website that says: "Impaired driving is a criminal offence and there are serious consequences for driving while impaired." Of course, that will be the official party line. I would not expect the province to say that in BC it is seldom treated as a serious...

You are right. For some reason, perhaps to free up court time, BC decided not to prosecute drinking/driving cases years ago. Instead, it implemented Motor Vehicle Act (MVA) amendments allowing for police officers to do "roadside screening" and to issue 90-day driving prohibitions. There are...

Maybe in parts of Canada, I can't say. I agree drunk driving should be a very serious crime in Canada. However, in BC at least, it's no longer treated as such. No more stigma of a criminal conviction. No risk of imprisonment. Just a 90-day driving prohibition, then carry on.
