My sister had her hearing. The hearing had a negative response and based on that we requested to withdraw her claim. We received a letter from RDP refused her withdrawal. I read that we can request for appeal to RAD. But how can they refuse a withdrawal after the hearing a negative response? Are the chances good to get her passport back?

I dont understand why you would wanna withdraw her case when shes already refused lol. You basically just leave unless you wanna stay, then you appeal.

Also pretty sure once refused the removal order gets activated. You need to mail them to have your passport ready at the airport for when you leave.

How do you withdraw after final decision on a claim? Make ticket arrangement and call CBSA to return your passport at the airport

In the refusal letter they have just mentioned about how to appeal and nothing else. Our Lawyer is handling it so thought they know the procedure.

The “appeal” is to appeal against their negative decision so they can review it and maybe change it to positive, which lets you stay jn Canada. But you have already showed intentions of leaving Canada so the appeal option doesn’t make sense in your case. What exactly are you trying to do here? Do you wish to stay or leave?

We wish to leave. I understand the appeal. After the decision when we said to the lawyer we don't want to appeal and leave the country they made us sign the withdrawal form and sent it to RDP. I understand form all your comments that this was not necessary. What is the next step we can take?

Make arrangements to leave Canada and then contact CBSA.
