Based on an assessment of the Labour Market, Service Canada (SC) has issued appositive Labour Market Impact Assessment (LMIA), and has confirmed yours offer(s) of employment to the foreign worker(s) indentified in the attached annex.
This SC Labour Impact Assessment is based on the information in your application, which is outlined in the attached annex. This confirmation is provided with the understanding that all the legal requirements, with respect to employment are followed.
These requirements include, but are not limited to:
All workers in Canada, including foreign workers, are protected bytherelevant labour and employment laws.
All workers in Canada are entitled to work in a safe workplace where their health isprotected.
If an employer does not pay the wages to which a worker is entitled, workers'- including foreign workers'- can file a complaint with the federal, provincial or territorial department responsible for employment standards.
Head office operating in Calgary must be licensed under the provincial Fair Trading Act. Section 9 of the Employment Agency business Licensing Regulation of the ear Trading Act states that " no business operator may directly or indirect demand or collect a fee, reward or other compensation from a person who is seeking employment, or information respecting employer seeking employees OR from a person for securing or endeavouring to secure employment for the person or for providing with information respecting any employer seeking an employee. Foreign workers maywork in Canada in this occupation for up to a maximum of 24 months ( Combined initial Labour Market Impact Assessment and renewal). They must the return to their country of permanent residence for a minimum of four months before being eligible to apply for another work permit. Employment contract
The purpose of an employment contract is to:
Have a written, detailed description of the job. It includes for example, the maximum number of hours of work per week, wage rate and whiter overtime will be paid. The contract must be signed by both the employer and employee.
Describe the terms and conditions ofemployment
Articulate the employer's responsibilities and the workers rights
Help ensure that worker gets fair working arrangements.
The employment contact must respect provincial labour laws that establish minimum employment standards such as the minimum wage
The contract assists HRSDC/Service Canada officers in forming their Labour Market Impact Assessment, pursuant to their role under the Immigration and Refugee Regulations
Employment contract
Employers must complete and sign a contract before applying for a Labour Market Impact assessment. The attached contract or another contract which include all the terms and conditions of the sample contract or described in the guidelines for employers, must be completed and signed bythe employer. Additional provisions may be added as long as they do not contradict the terms and conditions mentioned above. The employer must complete and sign the employment contract and send it to the foreign worker ("the employee") with the copy of confirmation letter he/she received from HRSDC. The worker must sign the contract and provide both documents to the Canada mission abroad.
Third'- party Representatives
A third'- partyrepresentative/ recruiter cannot be party to or sign the employment contract on behalf of the employer or otherwise.
Any agreement respecting employment validation between HRSDC/ Services Canada and the employer is contingent on the employer being a party to the contract.
