Will Filing a Mandamus Adversely Affect my Immigration Application?
As experienced Canadian immigration lawyers in Toronto, we’ve heard this question on countless occasions. In fact, it’s the one we are asked most frequently as clients are concerned about IRCC “punishing” them for taking them to court.

It’s understandable that anyone trying to apply for residence in Canada would feel concerned, but no: filing a mandamus will NOT adversely affect your application, and IRCC will not punish you.

The rule of law is fundamental to Canada as a country, and a writ mandamus is a legal remedy available to applicants who believe they have been subject to an unreasonable delay in the processing of their immigration application.


You'll get the same answer you'll just get it faster. With mandamus rejection will waste your 2 years, without it'll waste your 4 years.

We should appeal, judicial review, we will say they're simply pissed off cause we brought them to the court because of their incompetence
But as I said all this will eventually lead you to 2023 ,not mentioning the waste of money.
Nobody wants a pushback surely they will retaliate with some bs

Many people don't understand this mentality dude. I'll pay 5K-10K for mandamus and won't even look back because as you said I can make that 10K back but my 6-12 months won't come back. I really don't understand why people are tending to demonize mandamus here.

As I already said it is not the money most I think is concerned about retaliation.

No retaliation mate, go for it if you have the funds. I can't wait to pass the 6 months mark then I'll go straight with mandamus.

Rejection by itself can be challenged in a judicial review.

The remaining 50% will go to CEC. Just do a couple of mega draws and be done with it.
In the memo, they are combining CEC and FSW as FHS. So 50% of the resource will utilized for TR to PR and Afghan Refugess. Don’t be surprised if a new sets of Refugees are taken from Ukraine.

My boss, my employer an old man at 70's used to tell me this.
My only worry at this point is if Steven or the likes of him are actually capable of giving me what I would happily pay them for. If this whole thing is gonna cost me 5K CAD + 3 months for the whole mandamus stuff (on top of the 6 months I'd have to wait after R10) with a guaranteed outcome (at least a significant speed up in my app, ideally a final decision) then I'll seriously reconsider my plans of going to EU. I can wait 6-9 months easily without worrying about my file if this thing really works.

CECs are already TR2PRs (they all qualify) so practically CECs will have access to same quota but FSWs will be subjected to increased competition.

Well. One thing for sure is that I am trying to find a case where mandamus was used and a judge stated that Covid should not be used as grounds for long processing time. I understand that Meurrens has done it but for obvious reasons, I am a little sceptica.
