The first thing I will say is NOT to be in fear. don't panic. Fear is oftentimes one of the reason people make a lot of mistakes and in some cases, run into the hand of lawyers that will eventually SCAM you of your hard-earned money!
The advice I will write has worked for me. I also gave similar advice to other members in the forum and it worked for them. there is a member by the profile name
@tony4454 who was refused and I told him how he can request a copy of the refusal letter from IRCC. It worked.
First and foremost. do you mind me asking if you use a lawyer and do you mind me asking if you trust your lawyer beyond 100%? Is the lawyer reliable?
I ask this question because MOST lawyers are NOT usually honest and not reliable. MOST will only take your application because they WANT YOUR MONEY regardless of the outcome of your h&c application. The pandemic has even made it worst. they are using clients as a CASH COW.
My first advice is NOT to depend so much on the use of a lawyer. There are some things you will need to have the balls to do by yourself if you are serious about increasing the success rate of your application.
Now, here is what you need to do :
1) Request for a copy of the refusal letter from IRCC: If you use your personal email as a means of communication between yourself and IRCC in your refused application, use the SAME email to request a copy of a refusal letter for your application. I assure you, they will email you the refusal letter in less than 24hrs as soon as they receive your email.
THIS SERVICE IS FREE
PLEASE NOTE: Ensure you include your full name, h&c application number, and UCI number in the email. this will make it easy for them to locate your files so that they can email you a copy of your refusal letter
Secondly, if possible; avoid using a lawyer to request the copy. they will scam you !... How ? they would not let you know how to request a copy. they will make it look like it is a complicated process. They use that will milk your hard-earned money till your account is zero!
2) When they email you a copy of your refusal letter, carefully take your time to read all the reasons they listed on why they refused your application. Try to make sure you understand all the reasons. Your understanding of all the reasons will give you an idea of what to do or documents/evidence you need to provide to counter all the reasons listed.
3) Seek the opinions of other people on how best to counter each of the reasons listed in the refusal letter. I will suggest you use people in this forum because most people in this forum are "experts".. we all did our application by ourselves and there has been a high success rate from every member in this forum. People will give you their HONEST opinion on what you can when you ask.
4) Once you now understood all the reasons for your refusal and how to counter them all, I will suggest you consider putting in a NEW h&c application. You should use this application to address all the reasons why you were refused in your first application. ensure you back it up with
STRONG ARGUMENT BACKED WITH EVIDENCE.....when you submit your application the new immigration officer will mostly be interested looking to see if you have addressed those reasons.
ALSO, SHOULD IN CASE YOUR CIRCUMSTANCE HAS CHANGED, PROVIDE EVIDENCE OF IT TO UPDATE THEM IN THE NEW APPLICATION
PLEASE NOTE: If you are very confident in yourself and you have very good writing skills, i will suggest you do the NEW application yourself. you know your life and immigration story than a lawyer... if there is anything you are not sure about when working on your new application, seek an opinion from members in this forum.
VERY IMPORTANT YOU KNOW THIS: Submitting a new H&C application has a
higher success rate than putting in an application for Judicial Review(JR). Most lawyers will recommend a JR because it's a way for them to make fast money. I have NEVER seen anybody that has gone through JR and got this application approved.JR is just a waste of time. To add more salt to injury, the pandemic has made it worst. You can wait endlessly for the court date for your case
