Hello,

I am in Canada as a visitor. Is there anyways for a potential employer apply for LMIA so I can get a work permit? Is this possible? Based on what I see online, there is currently no way to get a new positive LMIA application under any caregiver positions.

It is possible if the employer has posted the job and can’t find anyone locally, then yes, the employer pays the fees and applies for the LMIA.

LMIA under Caregivers are no more approved by the minister. You will have to apply under Occupation Restricted Open Work Permit

I said, LMIA based work permit for Care Givers is no more in action.

Under HCCP and HSWP, you dont need LMIA

My sister in law is in canada on a visitor visa. My sister wants to work as a caregiver so we been going through agency placements that friends of ours has used before with sucesss everytime. My worry tho is that the employer only starts processing the lmia once they find a caregiver. they expect her to work while the papers are in process and each agency says that's how it is and until the they get positive lmia and work permit it's going to be cash jobs . how is that legal ? when i see the canada page it says if you have no work permit you cannot work.

It is illegal as per the Law.

The processing time for Caregiver program is more than 12 months, So I dont think you want your sister for work for 12 months without proper papers.

Also, there is no LMIA required in Care giver programs, they scrapped it in year 2019. Now, IRCC is processing Occupational Specific Work Permits.

Foreign credentials
For applicants with a foreign educational credential, the ECA report must

  • indicate that the credential is equivalent to a completed Canadian one-year post-secondary (or higher) educational credential


If your NTT course had a minimum requirement of Grade 10, then it will not work. However,
if your NTT course had a minimum requirement of Grade 12, then it can work.

The best way to find is, to send the Transcripts of NTT course to WES for ECA.

If the outcome says "1 year of Post Secondary Education" then you are eligible for HCCP / HSWP program.
