How do you feel like if you went to the hospital and filled out a paper form for your procedure and waited and get cancelled on 5 times, and a bunch of other people come and apply with a new online system that the hospital put out and while you are waiting, possibly in pain, you see these people who filed the forms online well after you, getting called for the procedure? Do not conflate the issue, please. It's not a pandemic issue. It's inefficiency and ineptitude and monumental lack of foresight. I was silent for 2 full years. I gave them benefit of the doubt. I didn't call except once, I didn't request notes. But I am up to here and am done with this.

guess what, as soon as I started calling and requesting notes, my background check went complete. There are people on the threads from 2019 who didn't do anything and their file didn't move at all, not even the background check. Do you know why? because their files have been sitting in the office collecting dust while IRCC management had a rude awakening in late 2020 and after possibly many zoom calls to somehow get around the backlog, they came up with the genius idea of ignoring us and move on to online applicants to meet their "targets".
That's what I'm telling everyone start applying again choke their system

Do you not think everyone has had to adjust to long wait times when it comes to most services in Canada due to covid? I had a medical procedure cancelled 5 times. I didn’t complain because I knew that everyone else was going through delays as well. I think I may get surgery in 2 years if I’m lucky. This has been a tough 1.5years. We have all had to deal with the government taking much longer to get back to you anytime you ask a question. PRs have access to all services and benefits that Canadians receive so for most just waiting will no impact to their daily lives. You aren’t stuck abroad waiting for another 1+ yrs to enter Canada or to get your application approved. Some are waiting 2 years to reunite with a spouse. Not sure how you are not being treated with respect? There isn’t a small number of people applying for citizenship who have been delayed there are delays throughout the whole immigration system. In general everyone in Canada has been affected by covid in a variety of ways. It’s unfortunate but we have to be flexible and consider that we are lucky that we’ve had access to vaccines, access to financial support, access to free treatment if we get covid, etc.

I agree with you. Applying pressure is key. As soon as soon I started sending webforms and calling my BG check completed after 14 months of submission and after that it’s been radio silence. No test email.

During the pandemic the UK processes citizenship applications in 8 months, and Australia in 14 months. Canada took 18 months to start doing something, and then there was a huge backlog that they cannot manage in a timely manner. Here what they say in their website about the processing times, which they updated recently to include some caveats related to covid-19. Before it was only saying 12 months for the processing time, which was very deceitful.

    • The 12-month processing time is how long it usually took us to process a complete application before COVID-19.
  • we have limited capacity to process applications
  • it’s taking us longer to send out acknowledgement of receipt (AOR) letters or emails
    • You’ll get an AOR after we receive your application and check that it’s complete.
Who cares how long it took BEFORE the pandemic. Put the processing time NOW. But I guess it's embarrassing to put 24+ months for their "efficiency reputation"

Have you used the healthcare system? This happens daily.

Does Mandamus works for PR outland applicants? I am waiting for almost 36 months for application. when I learned through GCMS that my applications is for pasport request I am planning to consider Mandamus as an option? how does this works guys? thanks

So I talked to a lawyer and he thinks it's still premature to file for mandamus. He did offer coming on record and starting pushing IRCC; but I got the test invite last Friday; I will just write the test and wait a few more weeks to see what's gonna happen.

When did you file your application? and what he means by "coming on record" to push IRCC?

Technically an individual can make an application for a Writ of Mandamus without a lawyer. This is, however, nearly impossible in practice. Mandamus actions are notoriously difficult to properly plead and argue. It is, for example, rather common for mandamus actions filed by lawyers to fail because of procedural technicalities (one lawyer, who had been clerking for a judge, told me "most" mandamus fail because of technicalities; this was about mandamus actions generally, not those involving IRCC as such).

So I talked to a lawyer and he thinks it's still premature to file for mandamus.
This is probably true for the vast majority of current applicants, including those who applied in 2019. Remember, there is NO timeline requirements for IRCC to process citizenship applications, so even a quite lengthy timeline will NOT be sufficient to get mandamus relief.

Please don't give me the pandemic excuse. There's only one reason and that's ineptitude and lack of foresight on the part of IRCC management. It's evident from the document obtained. and they are worried about legal consequences too.
Opinions likely vary. But not all opinions are created equal. The Federal Court is very, very likely to give a great deal of weight to the argument that there has not been an unreasonable delay in processing citizenship applications given the impact the global pandemic has had on processing timelines.

On the other hand, imprecise allegations of "ineptitude and lack of foresight" are not likely to be given much weight. If any. (I suppose one could make a kind of res ipsa loquitur argument, but that is not likely to go far)

It warrants remembering that to prove there has been an "unreasonable" delay, the applicant needs evidence to show that IRCC has in fact "delayed" processing. The vast majority of applicants, again including those who applied in 2019, will probably have difficulty proving that processing their application has been delayed, let alone that the particular reason for or cause of the delay is "unreasonable." Explaining this would require wandering deep into the weeds, but the gist of it is that the lack of any processing timeline limits in combination with circumstances in which a large percentage of applications are concurrently suffering lengthy timelines, mostly evidences a slow process, not an "unreasonable delay," even though many will argue, and many will agree, that the process is so slow as to be unreasonable. The latter does *not* a cause of action in mandamus make. Sorry.

freediagram's timeline is apri2019 hence the lawyer he/she met said its not time yet(- 2yr 4m). So it looks like, that lawyer is expecting to clock 3 years before taking up the case for mandamus.
