Hi, I have received my second refusal today from the UAE office.

I applied for PGBA in Humber College and got a refusal on the first application. I had already applied for Masters and was waiting for the offer meanwhile, after the first refusal and obtaining my Masters admission, I applied for my second application for Fall 2021 intake and received a second refusal. same reasons as my first:
  • immigration status
  • family ties to country of residence (1 application shown return to UAE and second application shown return to India)
  • purpose of visit
I have applied for GCMS notes and will reapply again since i have started online classes for my Masters program. I wanted to seek your advise if I need to take help of a immigration lawyer or apply by myself again. for the third time (first application was through consultant)

To apply from home country is difficult as we have to establish ourselves first and then apply. SO confused. Please help.

we need to get GCMS to know the reasons , did you give a good explanation while reapplying

I think so. I am not sure what is the issue really. I have enough funds, progression of career, I am telling them in my second application, ill go back to home country.

I cant apply from India bcos I am not staying there. I have to apply from UAE as this is my current location. I know this UAE have bad reputation, this is reason i am thinking should i got again through an immigration lawyer, as applying myself the third time, will they just refuse it without checking it.

yes, get a lawyer.
the lawyer will guide you on how to build up your argument.

Guys,being an Indian and if you are working in GCC where do you think it’s best to apply for study visa.Consultancy says it’s okay to do from wherever necessarily not SDS but after having received refusal even after applying thru sds stream working in GCC it didn’t make any difference because in the forms where we mention our work& education history Visa officer can understand and also if they check passport they will know where v r and that’s how last time even after sds ,file went to Abu Dhabi office. So guys what do u say? Applying from where for SDs stream makes it fair ? Atleast majority vote

i know many cases where they transfer the file to Abu dhabi , as you have said , one option which one my known lawyers said is to go to india so that stamp is there on your passport , get medicals done in India , and apply . if the visa expiry date is closer , you may explain that you are going to settle in india ,

Again this was an advise , i am not sure if this works

Sorry to hear about the refusal. Generally it is much more difficult to establish a proper immigration status in the eyes of the VO while living in the UAE, because ultimately you do not hold permanent residency here and they don't think a visa is enough of strong reason to return back. I believe your SOP you should mention return to both UAE and India, as this information has already been documented in both your previous applications, otherwise it might seem like you particularly left out your intended return to UAE.

I would also suggest you apply through an immigration lawyer in Canada and not through a consultant here. The difference being that firstly any lawyer would draft a legal submission letter that is submitted along with your study permit application, and that would be the first thing that any VO would look at. The letter is meant advocate using specific case law within the Immigration Act to support everything that you are saying within your SOP. I'm not sure if you have already attached a Letter of Explanation along with the application, but if you haven't make sure you specifically address the reasons for refusal, after you are able to acquire the GCMS notes and assess your VO's notes carefully.

To apply from India I believe you would have to live there for a while and maybe find a job and establish yourself before you could apply. If you just enter the country and apply, I'm sure the VO would realize that you have only visited India to submit an application and continue to reside in the UAE and/or have a work history here. The problem is they might not believe that you will return back to your home country even if you keep emphasizing this because you already live outside your home country. It's the same case for anyone applying from the UAE. Another thing is that I have heard is that once you receive a refusal, I think they flag your application, so any future applications are refused on the same grounds as the previous refusals, and they probably don't even go through the application again just blindly refuse. I know it is unfair but that's just how it works with them, been through the same thing and it is very frustrating.

Yes, I do think that there seems to me that the only to overcome a refusal is to employ the help of an immigration lawyer (not an immigration consultant as they just submit on your behalf but don't attach a detailed legal submission letter). Make sure you get the right lawyer to represent your case and research thoroughly before going ahead with a lawyer as it is quite expensive. The VO is likely to assess your application more carefully if it is submitted through an immigration lawyer within Canada.
