BECOMING OUT OF STATUS DURING SPOUSAL SPONSORSHIP

Hi everyone,

I am sponsoring my husband under spousal sponsorship for which we also sent an OWP application. When we applied he was in a TRV which expired 10 days before they returned his OWP for missing fees. Then we applied for restoration of status right away but we haven't heard anything yet. Now, I recieved SA and he was asked for a country specific police record which we are sending.

This is not really a question but has anyone had any experience with spousal sponsorship while out of status?

I have had 2 panic attacks recently because of this situation and need to know I'm not alone.

Your hubby will be fine . Out of status people are allowed to be sponsored.

I’m out of status for over 2 years now and have just sent my common law sponsorship application this month. You will be ok. Don’t worry

There is a public policy in place for spousal or common law sponsorship application so they won’t kick you out while your sponsorship is in process. The link is below for that public policy if you want to read.

You can still be removed but they do normally wait for the outcome of your sponsorship application.

You can still sponsor someone who is out of status. If your spouse is out of status they won’t qualify for an OWP until AIP.

Thanks for all your support. I just feel bad. I don't want it to have major conveniences in the future. I hope everything continues to be okay from now on.

You can still sponsor someone who is out of status. If your spouse is out of status they won’t qualify for an OWP until AIP.
If my spouse is not attending school, in imm 5669, -Personal history section should I mention he is unemployed/not studying/working as most recent activity or should I mention the school he was enrolled in

hi. Did you end up applying for OWP ?? My husband is out of status and just received AIP but when going to apply for OWP it asks for expiry date of visitor status and then says can’t apply. Should I just put future date? Thanks in advance!
