My whole family is in Canada, I am 70 and single ,staying with son and taking care of grandson, good health n good finances. I am taking care of grandson aged 7 right from birth in home country and in Canada for the last one year. We entered Canada last year, my son on PR and I as visitor. I cannot wait Parent and grandparent(Income three years) and super visa (Out of Canada n waiting time one year)What are the chances of H and C application ? Ties to Canada, BIOC n establishment of family as elder son well settled. Kindly guide.
Some persons have cases like yours and they get apprivals but others get bad decisions, if depend on your arguments and evidences and also your principal explanatery letter has a big importace, things like your home country situation, support letters and other proofs like articles reports, photos, are important.
What did you put to prove your establishment, the best inters of the child and your hardship grounds ?

Thanks, I need honest opinion because a similar case got pr after refusal
Here you go I will break it down for you hopefully that helps you so first of all when you send the application they are two kinds of officers one of them are really compassion who Sees your application differently way and they gonna give you compassion to be together with your grandson
and the other officer are goes by the rules so when they see your application they see your son laziness because your son can sponsor you but he doesn’t want to do sponsorship
He wants easy way out So you will get refusal you might be don’t get a sponsor again or cannot come as a visitor
The professional person who give you advice
He or she wants your money all I’m saying your chances are 30% approval 70% refusal it’s your choice it’s your decision

Seems like you already make your decision
Good luck I hope you become permanent resident be together with your family

Hi,

There's no legislative, regulatory or written policy that I'm aware of that would prevent a failed H&C applicant to seek entry to Canada as a temporary resident.

But for those who require TRVs, you've described how you have to return in order to get the original TRV, then you've described why you can't return to have a PR application processed and must remain in Canada, and so you'll return again to describing how you can't remain in Canada with a new TRV application.

It's awkward. I suppose that there are cases out there where these contrary perspectives offered by a single individual over a period of time might make sense. The real risk, as I see it, is that an elderly parent seeks H&C, fails and leaves and is never permitted to return to Canada without PR status as their situation deteriorates.

The decisions that have to be made at later dates may well cause one to question the earlier wisdom of submitting an H&C application rather than a super visa with accompanying attempts at the PGP lottery. Life's a gamble, right? Immigration is voluntary so the adult child that cannot part with the parent who cannot be in Canada has a simple solution in order to avoid abandoning them at their point of greatest need. Maybe that's the real test of compassion - not what Canada can do, but what the adult child will do.

Good luck

You’ve already attempted to secure PR so trying to convince IRCC that you only want to visit Canada in the future could be very difficult. That is the drawback of parents applying for H&C. Have you been able to renew your visitor status or are you out of status?
