Hello everyone.
I have a quick question, I am a citizen and my husband is currently out of status here in Canada for 14 months. I am preparing to sponsor him inland but my confusion is, should he apply for restoration of status prior to starting the sponsorship? I need your help.

You can apply for restoration of status with your application.

If there is a way to restore beforehand he should do that as applying for restoration of status may delay your processing time.

If you can restore his status he could then apply for an OWP at the same time and be approved before AIP. Due to covid if he still had status in January 2020 he can still restore his status. There is a time limit for when you can still apply for restoration so you should apply soon.

Right I keep forgetting 14 months ago is still in the COVID extension timeframe.

Our lawyer submitted our restoration of status and my OWP at the same time - but they have to approve the restoration of status first, which apparently will kick me to the back of the line in priority. He isn't expecting my application for my work permit to go through for another year and my full application he is expecting to take two more years!

Try to restore his status ASAP if you can!

I do not get it, why didn't he apply for an extension (so he can have an implied status instead of the "out of") ?

Things happen - does it really matter WHY it happened? The point here is right now he is out of status and they are trying to correct it. If he is eligible for the restoration of status do it ASAP so he can be in maintained status (previously called implied status).

Sometimes it matters, in order to understand the context, so he might be prepared to explain why it happened. A restauration is not automatic.

As a part of the application, they'll need to explain it in detail yes - but it doesn't change the first step nor should it change our answers. See if he is eligible for the restoration of status extension that is available before submitting for Spousal Inland Sponsorship. There is no guarantee of approval and nothing here is automatic.

I sent a IMM5710 application to change conditions with my sponsorship application and I applied for a work permit too but I never got a decision about it.

What is your timeline? Found it in the other thread. - Maybe we need to stick to one thread as it looks like two are going with the same people/subject. :D

My timeline:
February 26 2020 application received. December 1 2020 Medical exam done. December 15 2020 Biometric done.
January 21 2021 Sponsor approved.
January 27 2021 Application transferred to Local office Calgary.
That looks like a bit of progress - from the other thread it looks like they needed to do a closer review and that is why it was sent to Calgary? Are you using representation?

Yes we’re using a representative, right now they’re doing my background check so we just need to wait and hopefully we heard something good.
