Visitor Status Expiry Help

Hi,

I applied to sponsor my common-law partner in November 2020 along with an OWP application. I have not heard anything from IRCC as of yet regarding either application except that the tracking showed it was received. My question is: My partner's visitor visa expired a the beginning of Jan 2021 but because we applied for OWP does that give them implied status? Or should we go through with the application to restore his status?

Yes, this gives you implied status provided your application is accepted as complete.

The only risk you run is if your application is returned as incomplete. That will put your partner out of status. In that case you will need to apply for restoration.
