Hello everyone, hoping you all are being safe and all is going well with y'all, I need your help with something, I want to start filling up my application for citizenship, prior to moving to Canada I was in the USA for studying purposes I did spend more than 183 days, but after that I went back to my home country and stayed there for about a month then came to Canada and became a permanent resident, do I need a PCC for the US or not? Because this part is a little confusing. Any help is greatly appreciated

If you applied for PR while being in US then you dont need to. if not apply for pcc for US. Nowadays it takes just few days only hence its not a big deal.

Thanks a lot for your reply I submitted my application on March 2016, went to the US for my master's in October 2016, I was awaiting my PPR while I was in the US, my application was completed in July 2017 and I became a permanent resident by October 2017 and never went to the US ever again, I want back home in September 2017 and stayed for a month, do you think I still need to apply for the PCC?

You just made my day better thank you.

Key factor is whether you submitted a U.S. clearance in the PR application process.

It also matters whether or not you have traveled at all to the U.S. since becoming a PR.

You clearly need to check [yes] you were in another country for 183 or more days within the previous four years for the U.S., at least if you apply within the next three months or so. So you will need to list the U.S. And the presumption is you then need to submit a U.S. clearance UNLESS one of the exceptions applies. If an exception applies, you describe that in the "Explanation" box in the chart provided for 10.b) in the application.

Based on what you describe, the closest example listed is "Example 1" . . . and if it applies depends on
(1) you provided a police certificate from the country (here the U.S.) "with your immigration application," and
(2) NOT having traveled to that country since you became a PR

First of all thank you for making things easier, no I didn't get a US clearence during my PR application, but I haven't travelled to the US since becoming a PR resident, and I am applying now, do you recommend me getting one, even if I have never been to the US since becoming a PR?

I was so stressed today, and you have no idea how reliefed that made me feel.

If you did not submit a U.S. clearance with the application, I do not see any exception which applies, so it looks like you need to submit a U.S. clearance with your application.

BUT I must emphasize that YOU need to FOLLOW the instructions as best YOU can sort through them. If you work through the application form answering items as they are asked, you can figure this out for yourself.

I do not offer advice (except the obvious . . . if the form asks for this or that information, sure, I advise the applicant to give that information).

I cannot make specific recommendations. I can offer general recommendations. Like be sure to wait to apply with a good margin over the minimum requirement.

So, OK, back to your particular query. Again, following the instructions . . .

First things first: how do you answer item 10. b) ? (All I have is the December 2019 pdf version of the application . . . so I do not know if the item number has changed). Is the accurate answer, for YOU, [yes] or [no] ?

Again, if within the preceding four years, as of the date you sign/make the application, you were in the U.S. for 183 or more days, the factual answer to this is [yes]. So, that is how you answer, [yes].

A [yes] response requires the applicant to list the country in the chart. You list the U.S.

Then you are required to submit a police clearance from the U.S. UNLESS there is an exception that applies.

What exception do you think applies? As I noted, best I can see is that example 1 is the only example that is close to your situation. For example 1, as I noted, you do not need to submit a police certificate IF BOTH . . .
-- you submitted a U.S. clearance with the PR application, and
-- you have not traveled to the U.S. since becoming a PR

Since you did not submit a U.S. clearance with the PR application, this exception does not apply. And, again, I do not see any other exception that might apply.

Thanks it seems that I must apply for one then, because you mentioned both of the conditions have to be included, I just did not travel to the US since becoming a PR and the landing process. Thank you for your guidance
