Common-law sponsership

Hey Guys ,
I am applying for common-law sponsership with my partner. She is canadian citizen and i am on study permit.We are dating since september 2019 and moved togther in december 2019. So the proofs i have are following-
1- Bank statements for last 12 months showing same adress( not joint ,but both of statements have same adress )
2- phone bills for both of us on same adress
3- car insurance since september 2019 because i received my quebec lisence in september,
4- her name listed as beneficery in my health insurance
5- my name as beneficery in her health insurance
6- text messages , facebook posts
7-things we bought together ( but the receipts does not show both of our names , just under 1 person's name)
8- letters from her parents , freinds , my friends
9- she was allready living in the apartment , so lease was under her name , and we signed new lease in march 2020 . But we got letter from our landlord confirming i am living here since December 2019.
10- we got tons of photographs
11-we opened a joint bank account in october 2020
12-gifts and cards we exchanged
13-documents from revenue quebec , cra to same adress for both of us
14- my CAQ from quebec government on same adress
15- we got engaged in october 2020
i am not sure if these are enough , and if i should submit the file or not.

Not clear who is sponsoring whom, but: the weak point here seems to be what OFFICIAL document(s) you have showing you living in the apartment since December 2019. (I may have missed something in the above).

That's not to say it won't be accepted, it is a matter that depends on the judgment of the visa officer.

Remember, 12 months should be seen as a minimum - and the technicalities of what can be documented can trip you up.

If you wish to be more certain, marriage removes the technical barrier to demonstrating common law.

The best part are the items, bank statements, phone bills and the letter from the landlord. Those are the ones that show the cohabitation between the 2 of you. The rest of it shows proof of your relationship. I think you will be OK but any more stuff addressed to you there will help. Any other statements for you going back to 2019? Your health insurance, registration with the school, credit cards etc.

I have the credit card with same bank dating back to december 2019 , other than than i received my T2022 form for my tax return from school
Other than that i received adress change letter from bank .

Thank you , I just have one concern , i lost my job in febuary because of COVID and i had to pay $14000 fee to my college. Luckily my partner was understanding and she was the one who was paying all the bills till july so i could pay all my fee.

Yes , would it come as positive sign that my partner helped me financially at difficult time , or would it be considered as negative that she was the only one paying all the bills

No it wouldn’t be a negative. Especially right now with the unemployment rate higher during covid. They are very well aware of this and I wouldn’t worry too much. You can explain all that in your personal statements that you submit.

Since you are already planning on getting married: if you get married before you submit, you substantially reduce the risk of a technicality or shortage of documentation (again, from the perspective of the visa officer) resulting in your application getting rejected for not meeting the common law test.

You can always have the larger wedding ceremony afterwards (esp since not known when covid restrictions will be lifted). If there are religious issues, most/many religions will allow for a 'blessing of union' event.

Note we can say 'civil marriage' and you can have a separate civil ceremony, but in Canada most religious weddings are combined civil/religious, with the officiant 'deputised' by government to conduct the civil marriage - that's the part where witnesses sign the marriage docs.

At any rate if religion is a factor, speak to the people at your religious institution. I'm sure in covid time they will attempt to be accommodating.

Not pushing, but I don't see why you would not get married before submitting app if you're planning to get married anyways.

I don't think it would have an impact on your app either way. Remember that you are trying to provide proof of cohabitation, I don't think the question is whether your relationship is genuine or not. You should consider what @armoured has said.
