I know many people ask about PGWP and OWP for spouse. My wife got her PGWP last week and I got approved for OWP yesterday, so here are my experiences and answers to some questions people asked.

Our situation: My wife was a Doctoral student and defended her thesis in January. She worked full time in a NOC A occupation (on campus) before the defense and all while waiting for PGWP. We applied for my OWP two weeks after she applied for PGWP. She got her PGWP for 3 years and I got my OWP.

The procedure is very straightforward, and indeed one of the easiest ones (we also have experience with applications for tourist visa, study permit and spouse OWP for a spouse of an international student). This was easy because it required fewer documents, and no proof of funds whatsoever. Some people feel it is helpful to include a proof of funds for the PGWP applicant or the spouse, but it doesn't seem to matter. However, one thing is absolutely, 100% necessary: to get a spouse OWP, the PGWP applicant/holder needs to have employment (even temporary, part-time) in a NOC 0, A or B occupation. You can get a PGWP without a job, but your spouse cannot get a OWP without you having a job in a NOC 0, A or B.

Why does a PGWP holder/applicant has to have a job for spousal OWP?

I know this requirement seems weird, because spouses are eligible for an OWP when you are a student. But you are not a student anymore; you are a worker (PGWP is an open work permit), and this is a different category of an applicant. Spouses of temporary workers can get an OWP only if you are a skilled worker. For other classes of workers (those with LMIA) it is clear whether they are skilled or not, because LMIA (closed work permit) tells what kind of an occupation you have. But PGWP is an open work permit, so they don't know you are a skilled worker. This is why you need a job in a NOC 0, A or B occupation for your spouse to qualify.

Please note that this doesn't have to be a permanent job, or even a full-time one. My wife works on a semester contract (she teaches as a sessional instructor at her University. Her contracts are typically for 4 months). This is because they are not judging your resources or how much funds you have; the job requirement is to confirm that the PGWP applicant/holder is a skilled worker. It also has no bearing on the length of the permit. My wife and I got a 3 year permit based on her studies, even though her contracts are short.

Yes, we can wonder why they can't deduce that someone with a Canadian university education is skilled (perhaps they want to see you actually working?), but it is how it is.

Furthermore - and this needs to be emphasized - the PGWP holder/applicant has to be already working. A new contract or a future job won't do. You need to submit 3 payslips to prove employment. I am not sure why they insist on this, but it is the requirement.

Can we apply together?

As always, you need to combine documents into a single PDF file to upload them under the same category.

Again: you don't need a proof of funds for any of you. I was unemployed at the time and it didn't matter. We put "homemaker" as my occupation. It is a legitimate answer. Not sure if it's because it a highly skilled, university job, but it was ok even if the letter didn't list duties. Maybe you need the list of duties only if they don't mention the NOC in the letter. So, if you can, get them to write the NOC on the letter.

Are 3 payslips really necessary?

And finally, we get to the payslips. The PGWP applicant/holder has to be actively working for their spouse to get an OWP. A new contract or "starting a job soon" won't do. You need to submit 3 payslips from their job to get an OWP. Without this, they won't give the OWP and the spouse will need to apply to change their status to a visitor until this requirement is met.

The good news is that "3 payslips" does not mean "3 months". Those who receive paychecks more frequently can gather this more quickly. I've heard some people here say that they had success with 2 payslips or even one (with an explanation in the application about it), but I am not sure how it goes, or if it truly works. Perhaps you can ask to update your application with new payslips as they arrive, if the processing time is as long as it is right now. However, I have to emphasize that I have no experience with submitting fewer than 3 payslips and no idea if if works or not.

i’ll be really thankful if you can answer one more question. my spouse is still in India and I’m on an implied status working in NOC A, waiting for my work permit since May 22, 2020. We’ve been together for six years but got married last year in May but he doesn’t hold a visitor’s visa for Canada. Can I also apply for his OWP right away? If you ever come across a similar situation ???

I am not sure how this situation is different than mine, except that your spouse will be applying for their first visa. I might be missing something, though. I believe he can apply right away based on your work permit application and your three payslips in NOC A.

Hi, I am a recent Postgrad from Seneca College.

Came to Canada in Dec 2019, I did 1 year Postgrad certificate course and graduated in Aug 2020 (of course the graduation letter states it is 1 year program). Since I have 90 days of time to apply for my PGWP, I am yet to apply for it.

My wife is already here in Toronto, working for a Customer Service role NOC C job since Aug 2020 (because of this pandemic we decided to go with some available job) till date.

Is it wise to apply together for PGWP and her OWP extension (I do understand that as per the details given by @SatNight, it is highly possible that her OWP extension might be refused.

What is the wise thing to do now? ( I would get just 1 more year to stay under PGWP). Can someone help me please!!!!

Do you have a NOC 0, A or B job? If not, I am afraid her OWP will be refused. You also need to check if she is eligible to continue working. The best course of action would be for you to get a NOC 0, A or B job, but I understand this might not be easy now. However, if you manage to do that, you can apply for her OWP once you collect 3 paystubs. Do apply for your PGWP though; that is the first step. Also, ask around this board to verify if your wife can continue to work - her OWP is tied to your study permit so she might need to stop working. I am not sure when she needs to stop working (if her OWP is still valid she might continue until it expires, but I am not sure).

Fortunately I am just getting response for my applications and all these days I just faced 2 interviews. Still a long way to go in my job hunt for obtaining a job in NOC 0/A/B.

Since I had given my biometrics before coming here to Canada, I have a strong belief that my PGWP will be approved and mailed within couple of weeks. hence I am delaying my PGWP application. I'll go with your suggestion to apply for my PGWP initially, get some job within Feb 2021 (worst case scenario) at least if I am lucky enuf and all my effort pays off.

I am little concerned with CERB too. Because I applied and received it thrice, of course I am 100% eligible according to CRA conditions. Hoping that my PGWP will not be refused because of that!!!!!!

Coming to my Spouse's OWP she has validity till 30th Apr 2021 (Work permit duration) so I think she can work until that date! (Do Correct me if I'm wrong).

Regarding the paystubs, I think you mentioned 3 paystubs and not 3 months of expr. and paystubs.

Yes, that is correct. I apologize for the error: it is 3 paystubs, and it doesn't matter if they are monthly or be-weekly (not sure about weekly, if those are available for that sort of jobs).

Thank you for sharing your experience..i am planing to apply for husband’s sowp ..i am in pgwp ..do i need to show proof of fund in my husband’s account as he is india and i hAve noc b job and also have 3 payslips...?

We didn't show any proofs of fund for me. My wife's job was a proof of funds, I think. However, we applied while I was already in Canada on a OWP as a spouse of an international student. We applied for a OWP visa of a PGWP owner. (We applied at the same time she applied for PGWP).

Thank you for the reply lawyer is saying to show eight lakhs in his account..we dont have that much to show..i thinking to apply by my own..not through lawyer..without showing funds..lets hope the best..thank you for the advice

I don't think you need a lawyer for this. Well, it depends on your circumstances, but if your case is straightforward (you are a person eligible for PGWP who has a NOC 0, A or B job and 3 paystubs), then I would say the application is straightforward. We did not show any money for me, only my wife's NOC A job paystubs. The main difference is that I was already in Canada on an OWP.

It might be useful to show some funds on your spouse's account, but I wouldn't know how much. What is also important, in my experience, is to include a letter with your application stating why you wish your spouse to be with you. It is an imperative not to mention any long-term plans for staying in Canada, just that you wish your spouse to be with you while you work in Canada.

I have a situation. Could you share your opinion?
My PGWP will expire at the end of March. At the end of September, I applied for SOWP work permit via my wife's PGWP which is valid until november 2021 with her 3 payslips of the NOC B job. It means that I applied 6 months before my permit expires The reason is that my company has more than 150 employees and I am the only foreign worker. Therefore the HR department doesn't know anything about Implied status and they request a valid work permit without a cut. Since the processing time for the Work permit reached 192 days, I had to apply it at that time in order to get SOWP before PGWP expires. Now, the processing times reduced, I saw some posts that if you apply for a Work permit too early, it might be refused. What are your opinions? Do you have any experiences with a similar situation?
