PGP Sponsor Parents - When am I eligible?

Why would you even suggest the H&C route ? That program isn’t meant to neither circumvent the programs in place or used as a get out of jail card for free

Who may use this application?
You may use this application to apply for permanent residence from within Canada on humanitarian and compassionate grounds (H&C) if you:

• are a foreign national currently living in Canada; (Parents on SuperVisa/ Visitor Visa)
• need an exemption from one or more requirements of the Immigration and Refugee Protection Act (IRPA) or Regulations in order to apply for permanent residence within Canada;
• believe humanitarian and compassionate considerations justify granting the exemption(s) you need; and ( Parents living alone, back home and you trust no one can take care of them, better than their own Children)
• are not eligible to apply for permanent residence from within Canada in any of these classes:
  • Spouse or Common-Law Partner;
  • Live-in Caregiver;
  • Caregivers: caring for children or people with high medical needs;
  • Protected Person and Convention Refugees; and
  • Temporary Resident Permit Holder.

I want to add this too:
Many struggles or may never reach the income cut off for continuous three years set (The funny thing, residents of Quebec only need 1 year of income, where the rest of Canada needs 3 consecutive years), as with time their family grows but not the income.

Just because this is listed it is not a recommended way to apply to sponsor parents. H&C is always for exceptional situations. Certainly some parents are approved but people are surprised that many are refused and take for granted that there are no consequences of attempting to secure PR via H&C. It is far from guaranteed even if parents are widowed, you are an only child, there is no other family in their home country, etc. There are plenty of examples in CANLII. Many are unwilling to wait until they get selected or wait until they qualify for PGP to try and sponsor their parents. If a family does not meet the income requirements to sponsor their parent they are still going to face a lot of concerns about someone’s financial status when they apply for H&C. One of the questions is always how a person is supporting themselves, if they are working as well as if they have an expensive disease to treat. Sponsoring a parent is not guaranteed when immigrating to Canada. Unfortunateoy some seem to be under the impression that that is the case and that is one of the reasons they immigrate to Canada.

There is nothing wrong to take a chance as the person just immigrated to Canada still has to wait and hope that the PGP program will still be in existence in the coming 3 years looking at the economy and health care system. So I would strongly suggest taking a chance. I wish somebody has pushed me to take that chance 3 years ago (and it is not listed as it is not recommended way to apply to sponsor your parents). Anyways I made it through the 8 min window in 2019, but still waiting for the final DM on the PGP application.

I repeat, Even if it is not approved, there is no consequence on the future PGP applications, as they still have to approve the applications if a Sponsor is meeting all the requirements.

There are certainly potential consequences. If you apply for PR based on H&C and are denied and then apply for various forms of visitor visas including extensions you can be denied because you have shown that you want to remain in Canada permanently. Yes there are no consequences if someone eventually gets PGP but there can be a long period between being denied H&C and being potentially approved for PR through PGP.
