I guess you need to read this again and again.Why would you even suggest the H&C route ? That program isn’t meant to neither circumvent the programs in place or used as a get out of jail card for free
Who may use this application?
You may use this application to apply for permanent residence from within Canada on humanitarian and compassionate grounds (H&C) if you:
- are a foreign national currently living in Canada; (Parents on SuperVisa/ Visitor Visa)
- need an exemption from one or more requirements of the Immigration and Refugee Protection Act (IRPA) or Regulations in order to apply for permanent residence within Canada;
- believe humanitarian and compassionate considerations justify granting the exemption(s) you need; and ( Parents living alone, back home and you trust no one can take care of them, better than their own Children)
- are not eligible to apply for permanent residence from within Canada in any of these classes:
- Spouse or Common-Law Partner;
- Live-in Caregiver;
- Caregivers: caring for children or people with high medical needs;
- Protected Person and Convention Refugees; and
- Temporary Resident Permit Holder.
I want to add this too:
Many struggles or may never reach the income cut off for continuous three years set (The funny thing, residents of Quebec only need 1 year of income, where the rest of Canada needs 3 consecutive years), as with time their family grows but not the income.
