Hey!

We are sending our common law/PR application today.

We are doing the out-land application as we are both currently in England, her visa runs out in November and we are gonna go back to Canada in November.

I am right in thinking that I am perfectly okay to do this as a visitor, on the 6 month eta visa, even though I applied "Outland"?

The plan is to stay there until it is hopefully approved in July/Aug next year.

You are correct, you have to do the outland since you aren't in Canada. Then having the PA coming to Canada thru their ETA is also fine. The PA should just say coming to CDA for a visit with you, not moving here. You can apply to extend the visa before the 6 months is up. Update IRCC with the new address in Canada after you arrive.

I am planning on going a few days after my common law partner goes back home to Canada!

So when I get to Canada, do you mean I should just tell them that I am coming to Canada to visit? rather than telling them I'm waiting for the visa/PR to be approved?

That is what I am suggesting. It can be done either way though. Yourself, coming from a 1st world country with an ETA saying you are coming to wait for your PR with you spouse is different than a person from a 3rd world country. CBSA would be less worried about whether you would overstay your visa. There is always the chance that CBSA would deny you entry if you say you are coming to wait for your PR to be approved.

Maybe @scylla or @canuck78 who are much more knowlegible could reply with their thoughts on the matter.

I am also worried about the whole COVID thing, I have to prove that we are common law at the border, as we didn't have any joint leases or bank/payments account, in our visa application we've had to put together lots and lots of documents and letters from my parents saying we stayed together here for over 1 year and paid rent to my Dad.

Would I have to show the same evidence to them at the border?
 
I am not sure how you would prove that during covid which you probably have to do, unless the restrictions are lifted they might consider his travel as non-essential and deny him entry. On the other topic you brought up I presume you have a lot more proof of your cohabitation than just the letter from your parents?

Yeah, we have pictures, letters that have came to us both here, letters for just her thqt have come here (all with our address on it) she also has pay slips/stubs, we paid for our wedding before covid and that invoice has our address on it.

do you think that’s enough. Obviously it’s hard to say but what do you reckon?

Quick one for you!

I just got my fiance to update her CRA account so it now shows that she is in a common law relationship effective from the day we became common law. Is it worth printing that page out and using it as "proof" or will that do nothing?
