Hello, my name is ninos khoshaba, I am 21 years old turning 22 in August 1st, in January/2019 I applied for refugee at Port of Detroit because I was inadmissable because of my 1 theft misdemeanor ( which im in the process of expungment, i got approved for it so it should be deleted off my record permanently in 3-4 months). After I was let in as a refugee, I had my court date October/2019 and I was denied because I wasnt eligible as a refugee for some agreement between the USA and Canada. I did not have a a lawyer and when I asked the judge she told me to wait for the mail. But supposdly I had 30 days to leave Canada and I did not know and ended up overstaying until the Canadian immigration sent me papers and I had an interview with them and we discussed when Im leaving which I left in February/2020. We already submitted a family sponsorship through my mom and its been a month since we've sent it out. But now I want to apply for a trp to see my family for a while, I am working now so I am able to get a letter from my work saying I am off for 2 weeks and I need to be back in town and I would have recommendation letters from family ?. My question is if I go and apply in person October since the 1 year bar for trp will be good at the border im I elgible if I go in person ? And do I need to fill out an application before getting to the border or do I fill out the application at the border ? If not at the border how do I obtain an application ?

In your interview with CBSA where you discussed leaving, were you ordered to report to CBSA when you left? Do you have a record of departure?

In my interview I was informed that my departure order turned into deportation because I overstayed then we discussed a date for me to leave and I left on that date. I had to meet with one cbsa officer before the border so he could give me the letter and give my passport and green card back so he can see me departure

I have the certificate of departure, it says type of order ( departure becomes deportation ), danger opinion issued was marked as no , removal under escort as no, criminality as no, detained for removal no.
And I've signed where it says deportation order and the date was 2020-03-18.
And cause of removal/inadmissable : 41(a);20(1)(a)

The advice the other times you asked still stands: https://www.canadavisa.com/canada-immigration-discussion-board/threads/please-im-ineed-of-help.690203/page-4#post-8729765

You should apply online, you probably won't get a TRP at the border since border processing is suspended and no one knows when it will re-open, and you likely need an Authorization to Return to Canada in addition to the TRP.

To be honest, it's very doubtful you'd be allowed a temporary permit after crime, deportation, and overstaying.

I know that border is closed im saying when they re open im i able to go? And do I need an arc if I applied for sponsorship ? Because it says if u already applied for sponsorship an arc would be only required when its approved and to not apply for arc as separate application

and I know i have litterally the worst luck in everything and the thing is im not a bad person or a criminal i just had a rough life and made one mistake when I was in desperate times , and the overstaying part I had no idea or else I wouldve left within the 30 days it was my fault but its too late for that. I'm just really keep hopping to go back no matter what I just need to see my family

You'd need an ARC for any return to Canada. If the sponsorship is decided first, you get an ARC there. If a TRP application is decided first, you get an ARC there and don't need it for the sponsorship.

If the borders ever open up again AND if IRCC resumes point-of-entry applications, you MAY be able to apply for a TRP there but you should expect to be refused. All the same advice from the previous thread continues to apply.

You can certainly try when the border reopens. You don't need an ARC to apply for the TRP. However you will need to bring all of your documents related to the failed refugee claim, your arrests and convictions, as well as the paperwork related to your overstand and deportation. You should assume the chances of approval will be very low given your history in Canada.

Im I able to apply for trp and arc at the same time at the border if they ever opened ?
The ARC would not be applied for separately. If you got a TRP, you'd be authorized to return to Canada.

Given your history, it will most likely not be granted. If you continue down the path of illegal entry to Canada, your sponsorship would be impacted, you'd be deported back to the US, and getting to Canada would be very incredibly difficult.

So basically I dont need an arc for trp ? All I have to do is grab all my documents and go to the border whenever it opens up and fill out the application at the border ? I know my chances are low but im desperate to see my family even if its for little while

I would encourage you to read what people write. We do spend a few minutes typing the words, please spend a few seconds reading them.

You do not need to apply for an ARC to get a TRP.
