Hii everyone, I have some trouble in my post graduate work permit application, I came here as a student and I applied for pgwp after completion of my study. After the processing time of 6 months I got a procedural fairness letter which says that I showed a invalid letter of acceptance from Georgian college in my study visa application officer said we did enquiry with the college and it seems the offer letter was not genuine so your study visa was issued in error so at this moment they canceled my visa and they give me 2 months to reply their PFL. I have never gone in georgian college I have completed my studies in another college. We did enquiry with my consultant in india it seems he really used a fake letter to gain my visa but I was not aware of this. I need advice please what should I do now. Thank you in advance.

This is sad, you have misrepresented. Even though your agent was the one who submitted fraudulent documents, you will be considered liable. Fill in the PFL and describe your whole situation, proof of studies etc. However, in my opinion the damage is done and since you submitted the application in your name, expect a 5 year ban and a removal order at worst.

You can of course, hire a lawyer, but such a choice would be costly and in most cases, of no use, and will further degrade your case.

You need a lawyer.

At this point there may be very little you can do since you obtained your study permit fraudulently.

Did you have genuine acceptance when you applied for visa? Why would he use fake letter if you have genuine LOA?

There's nothing you can do. The documents you submitted for your study permit should have had an attestation by you, that you allow a representative to apply on your behalf. The consequences still lie on you, not your representative.

Thank you for your reply I Already hired a lawyer who is going to reply for PFL on my behalf. He is really expensive lawyer but I don’t mind to spend some more money because this is my last chance. I have successfully completed my studies in canada and have never broken any rules regarding working or studying they should consider this as well. This is really a tough situation for me and my family.

I’d also report the agent and include that in your PFL.
My lawyer did the enquiry about agent and he found that agent doesn’t have a license so he said we cannot file any case against him because this is our fault that we chose a unlicensed agent. I was not aware about all these things that time. My all documents which I gave to that agent were all genuine I don’t know why he used a invalid letter for my visa.

you should tell the agent, is he frm punjab or which country please name it

You should also apply for the caips notes with docments. You will know that which docs he submitted at that time when he applied.
Caips notes with docs ( GCMS PLUS ) will Provide your complete file including docs, forms which he submitted that time.
Make sure you record call or chat history with your old agent where he considered that he submitted all genuine docs e.t.c. and try to continue discussing on this matter regarding fake docs. And show this in court when you put judical review.

1. It really doesn't matter who submitted the fake documents. The OP stated that everything was genuine when the application was stated. Also how is s/he going to get around using an unlicensed consultant, who s/he probably didn't declare.
2. I think that you will find if his/her lawyer tries for leave to appeal to the Federal Court, s/he is not going to overcome "the clean hands" doctrine when applying for leave.
