Applied inland, no confirmation yet from IRCC, need to extend stay for spouse

Hi,

We have applied for inland sponsorship end of February, the package was delivered by Canada Post on February 25th. Since then, we have no received any confirmation from IRCC that the application was received nor were we able to link the application. When we contacted them via the website they mentioned that they are operating on skeleton staff right now and that is most likely the reason why they haven't yet started processing the application and before they start processing it will not be in the system.

From that regard, my wife doesn't yet have implied status, and her last entry to Canada was end of December, 2019. This means that the 6 month period of visitor stay ends at the end of June, 2020. With that being said, I have the following questions:

  1. Should we apply for extension in this case or my wife does actually have implied status, regardless of whether IRCC confirmed receipt or not?
  2. Extension application form:
Details of visit to Canada section
  • Purpose of visit: is it "Family Visit" or we specify "Other" and in text box say "Permanent Resident Spousal Sponsorship Application"?
  • Indicate how long you plan to stay: Should the "From" be the date when the current 6 month period ends (e.g. 6 months from last date of entry) or should it be from date of submitting the extension application and "To" should be 6 months from the "From" date?
  • Funds available for my stay: Do we provide a print out for the amount on my (spouse) bank account? Given that the question "My expenses in Canada will be paid by" we answered "Other" and Spouse (me). In other words I am paying for my wife's expenses while we wait for the open work permit and application processing
  • Name, address and relationship of any person(s) or institution(s) I will visit: Is it myself (spouse) as 1 and another name(s) for the 2 visit?
Background Information section

  • Question 2c: Have you previously applied to enter or remain in Canada: Should we specify the original visitor visa application or should we explain that we applied for sponsorship and permanent residence, but have not yet received confirmation from IRCC?

1. She has valid status as a visitor until the end of June. It is only at that point that she would have Implied Status. Implied Status does not depend on receiving AOR.

If you want to apply for a visitor extension, it is too early. Wait until mid-June.

CIC website says that extension should be requested AT LEAST 30 days BEFORE the status expires, he said her status expires in June, if she waits until mid june and thats after her status expires, then she would need to apply for status restoration and that could likely complicate things for them. I would apply early May, especially now that the COVID is slowing everything down

1. The 30 days is a suggestion. You can apply for an extension up to the last day of your status as long as the application reaches CIC before you status expires.
2. As long a person applies for an extension before expiry, they have implied status until CIC makes a decision.

Thank you very much for your replies. Since the extension submission is electronic, it is most likely safe to submit early June, as long as everything is complete in the application.

With regards to implied status for the sponsorship application. Since IRCC did not formally receive it yet, and since we don't know whether it was handed over properly to them, can we really expect an implied status without formal AOR?

As said above, 30 days is a recommendation, not a requirement. They said the status expires at the END of June, so mid-June is not too late.

It doesn't matter if COVID-19 slows things down, as they would still have Implied Status during the wait.

As long as you sent the package with tracking and know that it was delivered, yes, you would still have Implied Status without AOR.

Hi there,
Your dates are actually very similar to my own. My Inland PR app was also delivered on Feb 25, and I have status from a visitor extension until June. I also submitted an OWP with the PR, so that should give me implied status while they're working on it.

I think we should be getting the Acknowledgement of Receipt any day now. I've been poring over the 2019 and 2020 family class spreadsheets, and the prevailing average for receiving it is around 50 days, but a few people that applied in January 2020 received it after 71 days. I think if you haven't gotten the AOR by May 6 or so, that will definitely be an indication that the processing times won't keep pace with their historical averages.

If you haven't gotten anything back at all from immigration by mid-late May, $100 for the visitor extension might be worth the peace of mind in knowing for sure you get implied status.

1. For Details of Visit to Canada: I put Family Visit and in "Indicate how long you intend to stay" I put the date I arrived to a date about 6 months later. The date I put here became the expiry date on my visitor record when it was accepted.

2. For funds available: I put an estimate of my husband and I's combined funds and I selected that the expenses will be paid by Other: Myself and my husband. You'll also be asked to provide all your financial information, so that's where you'll want to upload bank+credit card statements together in one document.

3. Name, address, etc: I think what you have is good.

4. For background information: I think saying both is probably good. Listing the prior visits and saying that you are submitting this to maintain status while the PR application is underway.
