H&C Applicant , Unique Case (Urgent Please Help)

Hello Respected mods Members,
It is my first post , please excuse me if its in wrong section .


My Medical Condition :-
I Have Hemophilia A with Inhibitors, its a type of blood disorder. If i get internal or external bleed it wont stop . Because i have factor 8 deficiency.

Now back to case , becase of admitted to hospital my first hearing was cancelled second one i attended . But they rejected it .
So i applied for H&C after waiting 1year . Applied in end of march 2018. They started to process sep 2019.
And few days back i received notification saying "we sent you correspondence on XX" then

I received mail for Medical Exam "this letter outlines information required to process your permanent resident status application"


Now Main Problem Is , when i go for reporting last time CBSA reporting . They handed me a envelope with they want me to fill and bring back on next reporting . Its a :-
Indian Travel Document Application form ,
issue of emergency certificate,performa of nationality confirmation status, Indian Council form . and A MAIN PAPER (Declaration Of APPLICANT) in which says something like "i swear i will not make any such statement for India and recant given in past ". I do not agree with this paper at all i won't sign this . . (Btw i will attach snapshot of them please have a look), i had my indian national Ids with me its in CBSA possation from beginning, My travel Document is definitely expried and i don't even have it .

So i have these two things going on with me both shown up almost same time.

Please help to understand what this all CBSA situation actually means , what are my options. What should i do , how to handle this. I am already struggling and stressed about my Health Conditions , its time sensitive i only have a Week , because CBSA letter also says failure to report may result issuance of arrest warrant and detention.


And please also put some light on my H&C situation ( asking for medical is good sign ? )
What is stage 1 and 2. , Where am i . ?

Case intro :-
I was a member of center left wing political party and for some reasons i faced assault(some other party supporters maybe) . Because for them i was easy target they knew i am disabled person and even a small injury is life threatening for me .

My Medical Condition :-
I Have Hemophilia A with Inhibitors, its a type of blood disorder. If i get internal or external bleed it wont stop . Because i have factor 8 deficiency. It won't stop until i get hospitalized and get special Medication infused after every 12 hours until bleed stops. People with hemophilia also have internal joint bleeds normaly , for that reason our joints starts damaging like elbows ,ankles ,knees and shoulders are common joints . So walking or others tasks gets effected. Me my self use a wheelchair for accessiblity. Hemophilia is a rare disease , but with Inhibitors makes it more rare. In addition , i have other conditions like seizures etc.

It means CBSA wants you to get a travel document so that they have the ability to remove you from Canada.

what are your grounds for H&C? Medical treatment for Hemophilia is available in India. Unfortunately I see no grounds for your case.

Bro its more complicated than that , not only medical base . There are other major.

It means CBSA wants you to get a travel document so that they have the ability to remove you from Canada.

H&C only have very small chances of approval. You were refused asylum and you can access medical care so there aren’t many other reasons why you would be able to claim H&C. H&C take around 3 years these days and you can be removed while you wait for the response. India is a safe country to be removed to. You really need to be speaking to your lawyer who knows your whole case but Canada is taking steps to remove you. Your best option is to move on and work to qualify for economic immigration. Do you currently have a work permit? Do you have healthcare coverage anymore?

Yes i have health coverage IFHP and i am keep applying work permit before previous one expire.

how do you still have IFHP when your asylum claim was refused before March 2018? How do you still have a work permit? Usually they are given out in 2 year increments and unless you got approved right before you were refused asylum it should have been denied at this point.


A medical as part of H&C is just procedure. They no longer do it in any sort of order.

You need to be working with a good immigration lawyer at this point.

You cannot simply ignore CBSA requests. You need to meet their request within 30 days. A lawyer can best advise you what additional actions to take.

The medical is a normal step in the H&C process. It is neither positive nor negative.

how do you still have IFHP when your asylum claim was refused before March 2018? How do you still have a work permit? Usually they are given out in 2 year increments and unless you got approved right before you were refused asylum it should have been denied at this point.

Yes brother you can reapply before it expires.

Medical because i have serious condition.

I heard now you can extend refugee claimant document as well . I am trying to do that as well.

The medical is a normal step in the H&C process. It is neither positive nor negative.

To the best of my knowledge you need first stage approval / AIP before your H&C application can prevent removal.

It can still take several months after the medical to get first stage approval. It's hard to guess and really on a case by case basis.

Hey scylla, i do not have travel Document , is that required for my H&C approval ? Or H&C can be approved without it.

And what should i see or what is indication that i got AIP .

Do you mean you don't have a valid passport? I don't know if H&C can be approved without a valid passport - I assume so.

You will get an email once you have AIP notifying you that you have reached first stage approval.
