No rule states that BUT we have seen cases recently where there is a clear intent to bring the whole family to Canada but they have been flagged as non-accompanying, and the Visa Officer processing the application has taken a very negative view. In some cases a PFL has been issued. Hence my concern at not "poking the bear".
The only cases I know of having issues is when the applicant does not state any reasons why spouse is unaccompanying.
Please can you post any links to posts where people are refused solely because spouse is unaccompanying even when reason is provided?
That is my point exactly. The Officer wants detailed explanation as to why she stated her spouse was not accompanying her. She was supposed to have written a detailed LOE explaining that they live together but however, the option was to raise her score to acquire PR status while her spouse will remain on TRV and acquire PR status once she sponsors him.....
LOE LOE LOE is the key here. How can one say she has a common law partner living right in Canada with her and then she states Nonaccompanying without giving details on what she's up to.
