No. The employer needs an LMIA to hire you.

Why wouldn't they be able to obtain an LMIA if 1. There is no one applying for the jobs. 2. They can't hire enough employees?.
An attorney advised me on this because he said alot of canadians dont like to do these jobs and Tim Hortons in particular hires foreigners..........

What's stopping them from getting one? They are already advertising all over the place and have ALOT of positions to fill that are not being filled.
The fact that the LMIA process takes 4-6 months, has strict requirements and costs the employer $1000 whether it's approved or not. You can certainly ask an employer to apply for an LMIA but be prepared for them to say no.

Can't they already have one while actively looking for employs?? Last I check labrador was running low.

Also how would Tim Hortons be hiring foreigners?? This place was actually recommended to me by my attorney. I expect him to be the expert. I was looking for others who have had the same experience. I will update when something happens.

Tim Hortons would need to obtain an approved LMIA in order for you to qualify to apply for a closed work permit.

Companies can apply for unnamed LMIAs but the fact that it costs $1000 and has no guarantee of approval means that most are not going to risk it when they don't even have a person to hire.
