I am filling application for my wife, there is one question on the checklist which makes me so confused. The question is The person I am sponsoring was declared as my spouse or partner and was already examined as a non-accompanying dependent when I applied for a permanent resident visa, and did not receive an immigrant visa.
Yes/ NO.

Working and studying – spouses and common-law partners in Canada
If your spouse or common-law partner already has a work or study permit, they may continue to work or study as long as the permit is valid. It is illegal to work or study without authorization from IRCC.

Can my spouse or partner work in Canada?
If your spouse or common-law partner already has a work permit, they may continue to work as long as the permit is valid.

If your spouse or common-law partner is living in Canada with you and is applying as a member of the Spouse or Common-Law Partner in Canada class, they can also apply for an open work permit when they apply for permanent residence. They must include a completed Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker form [IMM 5710] (PDF, 484.21KB) and the correct fee, explaining that they are applying for an open work permit.

If your spouse or common-law partner has already submitted an application for permanent residence but hasn’t applied for an open work permit, they can submit a completed IMM 5710 and the correct fee to this address:

Please note that it is unclear if we need to complete the checklist because it doesn't include the option for application under spousal sponsorship. Some did, some dont, but we have yet to see on the forum anyone who had their application returned because of this.

Yes, IMM5556 (06.2019) checklist--documents list:
Photocopies of passport pages clearly showing each of the following:
· the passport number;
· the dates of issue and expiry;
· your name and date of birth;
· the stamp made by the Canadian authorities on your most recent entry into Canada; and
· any other marked page.

Well, the good thing is you saw many samples that they got OWP only with 5710 and receipt. Do you remember from which month? I really hope everything will be fine.
Thanks, I edit another post to say I noticed that I missed 2 points. Oh well, we shall see. I doubt and certainly hope they wont return the application for that.

1. 20 pics to prove relationships, on back of it can we type out everything on MS Word, cut it and glue it back of each pictures? This way it is easier for CIC officer to read and I can add more info.

2. Personal history of PA, do we have to include any travel history that is just for a week? It does say, do not leave any gaps.

I'm with you on that. You want to fill the forms correctly but left with so many questions.

The pictures, you can write it by hand. That's what I did, following the guidelines of the photos for PR. It's not allowed to stick something on it so that's why I wrote by hand. Just write neatly. Or check in previous thread if anyone said anything about it.

2. Regarding the travel history, we wondered the same. Then when I read, it seemed they were asking to put everything including if they are not working. So I guess if you are working somewhere for 1 year for example, you don't need to put everywhere you travel during that time. But if you were not working and travelled to another country, you need to put it.

Yes/ NO.
In my opinion, they ask when you applied for PR before, the person you are sponsoring now was showing up on your PR form as spouse/partner, but not coming with you at that moment.

Hello Everyone! We mailed out our application on October 15th and it got delivered October 17. I hope all will be well since my anxiety is through the roof waiting to see if it goes through or if it will get sent back despite triple checking it before it got sent out. I'm grateful to be around other people in the same boat and to go through the process together with. :)

Can a USA citizen - Principal applicant travel back to country once applied for the sponsor application and OWP? I have got mixed answers about not leaving the country vs being able to travel.
What would one need if they need to travel for family emergency purpose or even just spending time with family for christmas and stuff ?

Id say to get the PCC as from what I read on the forum, it can be pretty lenghty to get it from here. The rest is pretty standard: driving license she can exchange as soon as she gets here so she has proof of cohabitation, birth certificate, etc. Translate documents that can be done before she gets here, start building the application with letters from family and friends, selecting pictures etc. All things that can be done here too but Id say the main one to do there is the PCC.

I think there are mixed answers because they are not based on experience but on the advices found on the cic website and what lawyers and consultants said. I also cant speak from experience but will share when PA travels. What you need when you come back would be copy of AOR, proof of financial means and cohabitation. Just in case and to show if you're asked. But honestly if you travel for a short period, they shouldnt make a big deal. Ive read few posts of those who traveled and they were not asked any questions or had any problems. Plus if PA is USA citizen and has proof of residence here, imo there is not much to worry. Just remember no matter what you read here, it's always case by case as it is the sole discretion of border service agent.

PR + OWP + Application to Restore Status submitted

Received: Oct 22

NB. Had previously submitted PR + OWP Sept 17 and application was returned October 17 for missing NOA (not sure how we missed that in packaging). Had to apply to restore status because we didn't apply to extend and I was by then out of status and implied status no longer existed with OWP being returned.
