Yes, In that you won't be able to get enough points to qualify for ITA

100% certain. I got one for my sponsor's late dad at the point of submitting my application.

You are welcome. Just to add that you need not mention that the individual is late though to avoid any complexities. All you need is 2 passport photographs + other information required to process the attestation of birth.
