Hey Friends,

I received my ITA along with my common law partner (accompanying) on July 10th, 2019, We both are here on PGWP. I completed my work experience earlier than him. We came to know that we are common law in May 2019. We have been dating since 2011 and living with each other since Sept 2016. We don’t have any Joint Utility bills as it is included in our lease. Also we both are not on lease as we live with my brother and his friends and they rented this house before we came here. We don’t have any Joint bank accounts as well I am going to provide following proof for our common law. Is this enough?



This is all we can provide?

Ø Statutory Declaration

Ø Licenses showing same address.( licenses dated 2017)

Ø Vehicle Insurance showing same address

We tried to get our status changed on our vehicle insurance policy, but they own had two options: Single and Married.

Ø Tickets from India when we came together in 2016.

Ø Phone Records.(one bill from July 2018 and one from July 2019)

Showing Constant calls to each other

Ø Our Photos with each other and each other’s family members.

We have attached 17 photos some of which were taken at the beginning of our relationship and some are very recent. We have also attached the photos taken with each other’s family members when we last visited India (in December 2018-January 2019)

Ø Screenshots of Social Media.

We both use Instagram more as compared to other Social Networking apps. I have provided screenshots from both of our accounts. Some of them are dated from back in 2014.

Ø Letters from Family and Friends

Both of our brothers and few friends.

Ø Credit card Statements with same address

both my and my partner’s credit card Statement. one statement from 2018 and one Statement from 2019 each.

Ø WhatsApp Chat History (Sept 2016-Jul 2019)

my and my partner’s whatsapp chat History from September 2016 till July 2019.

Ø Visa Stamping on November 1 is when we visited his uncle in new Jersey.

Ø Interact etransfers history

Interact History from 2017-till now.

Ø Receipts for Marriage booking.

We both are getting married on 8th December this year and have the receipts for bookings like marriage hall, etc

So, there´s one thing that IRCC will be looking for, as indicated under section 1 of the statutory declaration, (d) Have declared our common-law union under the Canadian Income Tax Act (T-1 "General - Individual Income Tax Return")

On the first page of your income tax return, you should have both declared your common-law status. You can include a scan of the first page of your most recent T-1s as proof of common-law status (instead of hundreds of pages of text messages).

Hey,

Thanks for your reply. We recently changed our status to common law on cra website dated 2017 September. we are waiting for a letter from CRA. and then we will be refiling our taxes. What do you think we should do?

Hey,

Thanks for your reply. We recently changed our status to common law on cra website dated 2017 September.

Hopefully you saved a copy of the form you submitted, and/or will receive the letter from the CRA very soon - you can use that in lieu of the scan of the T-1.

You might have another problem with the CRA. If you filed your taxes as single when you’re common law then there might be a review. If you’ve been getting GST benefits as single when you’re common law then you might not have been entitled to the amount you might have been receiving.

We are ready for it and we can certainly pay that back. We didn't knew that we are common law before or we would have filed as common law.
