Visitor Visa for Niece - 18 yrs old

I currently live in Ottawa and Permanent Residency status. My niece is staying with my parents (not legally guardians) in India almost her entire life after my sister passed away. She is now 18 years old, and studying graduation.

I recently applied Canadian visit visa for her to travel Canada and stay here for around one month in summer and to celebrate my son's 7th birthday. But, her visa refused for 2 reasons and visa officer not satisfied that she will leave Canada.

1. Family ties in India and Canada
2. Purpose of travel.

I have included certificate from her university to show the proof that she is studying and CA letter to show she has inherited financial status, and my invitation letter with proof of funds, all documents of my family here (spouse and 2 kids) like passports, PR, my younger son's canadian passport, address proofs, bank statements and T4- Notice of assessments for past 3 years.

I am planning to re-submit her visa. I bought home recently and would like to invite her for my house warming ceremony which happens in September end. What are the chances for her to get VISA.

My parents have already Visit Visa and my mother already traveled to Canada last year. My parents also coming to Canada for ceremony. And my mother recently hospitalized, and she will need assistance during her canada trip too. If I include letter/Notary affidavit from my mother, that she will be travelling to Canada again and my niece assistance will help her during her trip, will that add any advantage? And does flight return ticket will really add benefit to Visa application?

It does not at all.

It is very unlikely your niece will be approved for a TRV in the near future, for those exact reasons why she was rejected.

One of my friends told me that will not work and my mother is not supposed to give letter that she is accompanying with my niece as my mother does not have any status in Canada. I don't think it would add an advantage. Others can help your mom during her stay...including yourself. Your father could as well, as you have mentioned both parents are travelling together. Plus many airlines offer wheelchair service that could assist. In my opinion it is not a good reason to come to Canada. I also think they will think coming for a house ceremony will be a poor purpose of travel as well. An aunt buying a new house is typically not a reason one spends thousands for what is likely their first trip ever. It almost makes it look like you are just looking for a reason to apply.

There is no harm in you trying again with new evidences and a proper purpose. Your niece fits the profile of someone who might overstay as shes young, single and doesn't have immediate family back home. Visa officer might think you would prefer that your niece come to Canada to stay with you, that is the challenge you have to overcome.

Its hard to say, the more times you apply the more desperate you can seem to just come to Canada at all costs. If you only have one refusal having just a second one shouldn't be a big issue. Just remember that on any subsequent visa applications to always tell the truth about previous visa refusals. Even if applying to another country, if asked always tell the truth about Canadian refusals or she could be banned. Canada bans for 5 years.

Is your actual purpose that you wish your niece can stay with you and study in Canada? Then get a post graduate work permit eventually leading to PR in Canada? If that is what you really want then maybe do not apply again and focus on that.

If you genuinely just want your niece to come to Canada and visit the family and then go back home then you can go for it. Just remember to always mention previous refusals.

Also if she marries someone in Canada having 1 or 2 visa refusals will not impact her spousal sponsorship either. As long as the marriage is genuine and there is ample proof of the relationship you should be fine.

You can apply for gcms notes and see what the visa officer was thinking when they made their decision. Then the best thing you can do is try to address those refusal reasons and apply again and hope for the best. Its best to apply if you think either you have added new information that was missed previously and can sway their decision, or that your situation has changed such that you can refute their refusal reasons.
As an example of situation change, they mentioned families ties. Lets say your niece gets married and has a child, the husband and child are not applying for a visa and just your niece. Now the ties to India have gotten stronger, a wife/mother is more likely to return back if her husband and child are not coming but back home vs fresh graduate single person

Sorry to hear about the refusal.
When did you apply and in how many days the decision was made.
I also applied for visa for my niece, and waiting for a decision to be made. She finished her graduation and is starting MBA in September. In her application we included the admission confirmation and fee receipt from the university (not sure if these help!)

After biometric done, in a week, we received, biometric validity/correspondence letter, then after one week, decision received.

Did you file application on own or through consultant? Last time,we filed application on our own. This time, I am planning to take consultant help from India. Not sure, how far, its helpful.

I did the application on my own. I am heavily reliant on the MBA admission confirmation which I attached to the application to prove that she goes back to India.

Not sure on that. After submitting application, within a day, received biometric request. We included letter from University that she is student of graduation. But, we didnt include fee receipt, ID, previous hall tickets. Planning to add them this time.

I am just wondering, if you get any decision on your niece's visa? I have applied for ATIP for detailed refusal reasons and planning to re-apply visitor visa after having GCDocs.

Unfortunately, our genuine visit visa application (just for visit purpose only) for my niece is rejected second time also for the following reasons.

1. Family ties in India and Canada
2. Purpose of travel.
3. Financial status (this is additional refusal reason compared to last time, but she has inherited financial status like personal bank cash, gold and property. We provided bank certificate, CA document, property valuation by civil engineer. But, refused for this reason which didnt happen first time even though same financial status).

This time we added, my niece university all fee receipts, bonafide, previous hall tickets, marks list, notary( my niece, her father consent, my parents, my notarized invitation) and also mentioned that my parents also coming on this trip, flight itinerary etc. We provided all possible documents and our genuine application for purely visit purpose declined second time too.

Unfortunately, my parents (who already have visa) and my nice not coming to my first Canada house warming celebrations. After my sister passed away (my niece was just one year old then), my parents treasure her as their daughter and my niece is like my daughter; we are emotionally attached. I have been taking care, supporting her mentally and financially. I have been missing my whole family (spouse, kids, my parents, my niece-daughter) in significant occasions and celebrations in Canada.

And

I and my wife taking care of my niece as parents since my sister passed away. And my niece will be equal inheritor of my assets along with my two sons. Not sure, what other problems arise in future like this Visa refusal. So, me and my wife decided to adopt my niece legally. As she is 18 years old, in India she is considered as adult. And we are working on adaptation process. I have read that up to 22 years, kids are considered as dependent children and we can sponsor dependent children. Not sure, if this is applicable in our case or adapted children in India.

Once, we adopt my niece, can I sponsor PR or Visitor VISA to her? We really don't need PR for her now. If she at least gets Visitor VISA, then she can come to Canada on holidays along with my parents and spends some valuable family time here. Yes, I understand, she can apply for Study permit or she can apply PR on own once she meets PR criteria factors like bachelors degree, foreign job experience etc. But, this will take time and she is not looking for her study in Canada. She will study in India only and stay in India with my parents.
