Work Visa Expiring, when can I return as a visitor?

Hi! My situation is that my Work Visa is expiring and I would like to stay as a visitor. My application to change my status to Visitor Visa was refused. I am from the United States and am wondering if I am able to go back to the states when my Work Visa expires and come back into Canada as a regular old tourist? Are there waiting periods associated with leaving and reentry?

There aren't any wait periods, but in your case you may be asked to explain why you're coming back so soon, especially since your extension was denied. CBSA may feel that you're trying to work. They have the authority to wave you through for six months as a visitor, or give you a shorter entry, or deny you entirely.

Thanks, can you give me any pointers on documents or things I can bring with me to the border upon reentry to help prove I do not intend to work?

No, how would you prove a negative? Why do you want to live here as a visitor anyway?

You just have to be credible. American citizens usually don't have issues (but it's not impossible to be denied either)

Right, so to improve my credibility I can do things like....have a plane ticket out of the country? a letter of termination from my previous employer? a copy of my bank statement showing travel funds?

Carry what you like, but you cannot prove that you will not work, since it's impossible to prove that, right? The officer ultimately has to take your word for it.

None of this will make a difference if the CBSA officer determines that you aren't being honest with him. If he finds you credible when he asks why you're coming, he won't ask to see any other documents.

Again, what's your reason for wanting to come to Canada? If you're trying to immigrate, there are lots of programs available.. give a little more information and I can point you in the right direction.

Given your extension refusal, you should leave Canada for awhile and re-establish ties in the US before trying to come back. If you leave and immediately try to enter again, CBSA could not only deny you entry but also issue you a one year Exclusion Order.

My situation is that in 2013 I came to Canada with a student visa, graduated from university with a BFA in 2016, and have been here with a post-grad work visa since then. This visa expires in July. For the past 6 months I have been employed as an assistant to a custom shoe maker (a position for which I am currently training a new person). I didn't seem to have any pathways through my employment to extend my work visa. I have quit my job and will be heading back to the U.S. a week before my work visa expires to take an intensive course for a couple weeks. I have some money to support myself without working, and would like to return to Canada after the course to explore the province I've lived in for the past 6 years and spend time with loved ones. That is my reason for wanting to come back into the country as a visitor. I didn't think it would be a problem, but am just feeling a bit concerned now that my application was refused.

In terms of immigrating, I would be curious to know if you have any suggestions of programs to look into based on what I've shared? Thanks again for your time!

When I submitted the online application I did not include the plane ticket out of the country or the letter from my previous employer.

Honestly, with 6 years in Canada and an extension refusal, you should really plan to stay in the US longer.
