Spousal Sponsorship Application. Previous Business visitor visa denied.

I am seeking your advice regarding my situation. I will be grateful if you could help me out or suggest the appropriate way.

My wife who is PR in Canada is going to apply for my spousal Sponsorship. We got married 2 months ago. she has returned back to Canada after 1 month of our marriage. I am in my home country.

Last year, I applied for Canada business visitor visa but my application was denied due to * travel history and purpose of visit*. My consultant had altered my family information in that business visitor application to make my case strong. According to the consultant that was the only best way to get the visa. My consultant as he told me he did my registration with any company as an employee and applied for my business visitors visa. But my visa was denied.

Now, our consultant who is gonna help my wife applying for my spouse visa said
First of all in spouse sponorship visa application he will not mention anything about my previous Canada business visitor visa and refusal. He said if Canada immigration officer will ask then he will explain that my consultant did this.

We are very confused. Me and my wife are thinking that we should already mention in our application that previously I had applied for Canada business visitor visa and it was refused. But the consultant said no need to mention before just wait if they will ask only then we should explain.

Could you please advise us what is the right way ?

Should l already mention that my visa was refused or not ?

Your consultant is wrong.

You must specify, where asked, if you have received previous visa refusals. Your consultant's advice is very wrong, and a good way to be banned for misrepresentation.

First ditch this consultant. He is giving you bad advice that could get you banned for misrepresentation.

Second, you are lucky you have not been banned already for stating false information/false documents for your Business TRV.

Third, your previous applications are in the IRCC database including your Business TRV refusal

Agreed. If your consultant is already falsifying your information, he will eventually get you banned.

if your marriage is genuine then you should have no problem telling the truth. always answer truthfully otherwise you could face a 5 year ban. Also consider yourself lucky you didn't already receive a ban for lying on your business visa. My advice is to get a new agent or try it yourself.

Then it should be pretty straight forward, get a new agent, get one from Canada as someone else mentioned.

You must recheck if your Business TRV was refused for Section 40(1). Don't ask the consultant. Hope you have a copy of the refusal letter.

Hi Bryanna,
In my business visitor application, my consultant provided his own email id. So he got the refusal letter. Later, I ask him to show me the letter then he send me an email that I want to show you.

I have the email and could you please check it properly and let me know there are 3 reasons mentioned in it. Is there any way to add screenshot of email here or can I send you the email ?

You must recheck if your Business TRV was refused for Section 40(1). Don't ask the consultant. Hope you have a copy of the refusal letter.

If you were refused only for Travel history and Purpose of visit then no issues for your spousal PR app

This refers to your application for a TRV to Canada. I have completed my assessment of your application and I have determined that you do not meet the requirements for a TRV; therefore, your application is refused.


In accordance with Section A11(1) of the Immigration and Refugee Protection Act (IRPA), any person wishing to become a temporary resident of Canada must satisfy an officer that he or she is not inadmissible to Canada and meets the requirements of the Act. This includes the requirement to establish to the satisfaction of the officer that the applicant will respect their conditions of admission and will leave Canada by the end of the period authorized for his or her stay.


In reaching a decision, an officer considers several factors; these may include the applicant’s travel and identity documents, reason for travel to Canada, contacts in Canada, financial means for the trip; ties to country of residence (including immigration status, employment and family ties) and whether the applicant would be likely to leave Canada at the end of his/her authorized stay.


Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the Regulations for the reasons explained below. I am therefore refusing your application.

· Having a legitimate business purpose in Canada

· travel history
