Hi,

Just some follow up questions to my earlier posts here.

1. Scylla mentioned that we can apply for PR immediately after marriage.
Aren't we supposed to wait for the official Ontario Marriage certificate which now has a 6-8 weeks waiting period?

1a. If yes, can we apply for extension now (her 6 months ends in 1st week of Jan. 2019) and mention that we're now married and applying for PR?
1b. If no, Can we just submit a copy of a signed marriage license and offician't marriage cert for PR app?

2. Is there a safe length for TRV extension?

3. We're planning a trip to the US soon, after the initial 6 months period. Assuming we get the extension, is her extension still in effect when we get back to Canada?
You need the marriage certificate - it's in your documents checklist. Make sure you read that fully.

If her TRV admission is close to expiry, you must apply to extend that otherwise she will be ineligible for an OWP.

They will determine the length of time the TRV will be extended. You can ask for another six months they may give you more or less.

The trip to the US isn't necessarily a good idea - does she have a multiple entry visa? If she is denied re-entry to Canada by CBSA, her sponsorship application will be abandoned and if you are married at that time, she will be unlikely to get another TRV.

Yes, she has multiple entry visa and is expiring in 10 years.

Yes, she has multiple entry visa and is expiring in 10 years.
You can certainly mention that. You could try to leave and re-enter Canada, but applying for an extension may be lower-risk if you're risk adverse. Not saying it's a large risk, but the risk is non-zero.

Her visitor status is expiring in 2 months, not her TRV.

Yes, mention that you are applying for sponsorship in the extension app. I suggest you pay the full PR fees and include that receipt in the extension app to show you are serious.

So my wife submitted her PR and OWP application on January 15, 2019. Today, March 18, it was returned because we only paid for the open work permit fee ($100) and failed to pay for the work permit fee that costs $155. Though we already paid for that last month and sent them the receipt thru the online Web Form as per advised by CIC customer center agent. Also, We've checked on the On-Line Services and the status of the PR is now being processed.

She also forgot to sign the IMM 5710 application form and didn't put a date on when she signed it. All the other documents like copies of passport, birth certificate and marriage certificate wasn't returned. My question is:

1. Do we have to print a new copy of the IMM 5710 or does she just need to sign and date the returned application form? (There was a received stamp but then it was crossed out so i dont know if we should print another one)


2. Do we have to submit another photocopies of supporting documents like birth certificate, passport and marriage certificate?

3. After we resubmit everything, how long will the process would take again?

She can resend the OWP app. It will be 3-4 months before it is approved. The visitor extension doesn't need to be approved first. She needs to include proof of the extension app and should include a letter of explanation.

AIP = Approval in Principle. Happens near the end of the inland process.

Note that if the visitor extension is refused, she will be out of status and will not qualify for the OWP.

When she gets her work permit, she will no longer be a visitor and so there's no need to extend her (at that point non existent) visitor status. The work permit will provide her with status for the duration of its validity (usually two years).

Since you can expect she'll get her OWP long before July, there's nothing additional you need to do.
