How long did the process take? Yours was only visitor status, right? You never had a work permit or study permit?
Yes it was visitor's status.....I submitted mine towards the end of October and my daughters early November, and both got approved sometime in mid jan

You applied the application by paper or online? I sumitted it by paper in edmonton on Oct 25 but i have not received anything.

I think you can apply to restore status if in the refusal letter you were not asked to leave Canada immediately.

I am also going to apply for a common law relationship application but I received a refusal of visitors extension today

If you are applying for family sponsorship under common law, you can also submit application to restore status with your package (it should be within 90 days of losing your status) and if restoration is approved you can submit OWP application.

Nothing is easy!! You should take into consideration the reason they refused your application to extend stay to reduce the chances for refusal on the same grounds.

I guess you arrived in September-October 2017.

IRCC has been gracious in giving you one extension.... and then you have been living through assorted implied status.

What was the expiry date of your TRV counterfoil stamped in your passport?

No it will not be seen marriage of convenience
Because my partner was already married and divorced we were passing the 5 yrs period in which he cant sponsor the spouse visa

I have to live with my paepart more than 12 months to apply for common law and we also waiting to pass that 5 years deadline ,which already passed in Jan
Soi want to apply for common law relationship and restoration of my stay

If your TRV expired in November 2018, you cannot apply to restore your status as a visitor.

IRCC will possibly not buy the common-law relationship story. If that was the case, you should have applied to extend your stay by providing evidence that you are in a common-law relationship and you need another 6 months or so to become one.

Like I said earlier, it is evident that you are trying any means possible to remain in Canada. This will be seen as an abuse of your visitor privileges. If you don't leave, it will turn into a removal order and then a deportation order. It's your call

This story will not be bought. Period.

There was nothing stopping you and your partner from living together even s/he was waiting for the divorce decree. It was a different matter that s/he could not sponsor you for PR for 5 years.

Also, based on your immigration application history, if you were in a common law relationship (or at least working towards it), you should not have applied for a study permit. Anyway. It is entirely your call
