Hello,

Me and my wife finally submitted her Permanent Residency application last week through Family Class Spouse Sponsorship.

I am hoping for some help in regards to Open Work Permit information, as after submitting the application I have become worried reading some information on PGWP converting to OWP.

I am a Canadian Citizen, she is currently on a Post Graduation Work Permit here in Canada. She has applied for Inland Spousal Sponsorship. We have also submitted an Open Work Permit application.

Her PGWP expires in June, and from what I have read after we submitted the application is that the PGWP cannot be extended. I did read there is the option for "Bridging Open Work Permit" however, it appears to only be for people applying under the working class immigration, it does not mention eligibility for family class applicants.

Will she get implied Open Work Permit status while we await the decision? Or since PGWP is not eligible for extensions will this not be possible? I cannot find other topics with this same situation, most of the other topics were regarding nominations, or not through Spousal Sponsorship applications, and now I am worried about her PGWP expiring before we receive an Open Work Permit, or if we find out she is ineligible for one while we wait for PR approval due to PGWP not being able to be extended.

Thank you, I appreciate any advice, and I apologize if I did not explain this correctly.

Yes she will get implied status through her OWP application. Only issue is she can't work if her PGWP expires and she hasn't received her OWP yet.

Awesome, I guess we will have to hope the OWP comes through quickly, otherwise she'll have to quit her job until it comes through I guess.

Another question I forgot to ask in the original post, I see it mentioned a lot that you cannot/should not leave the country while awaiting approval on your PR application. If she does get approved for OWP are we allowed to travel together? We would like to go on a vacation this year, but conflicting information online makes me feel a bit uneasy doing so.

Thanks again for the help.

Sorry, after re-reading this, may I ask for further clarification on one part. You mentioned she would get implied status through the OWP application, but wouldn't implied status mean she can continue working until approval is recieved even if the PGWP expires while waiting on approval?

She can leave Canada but if refused re-entry, the inland app is abandoned. The chances of refusal are very low but the risk is always there.

She will have Implied Status as a visitor between PGWP expiry and OWP approval.

Awesome, thank you both for the clarification. Your posts in other threads were a huge help throughout the application process as well.
