Misrepresentation

I am a US citizen (recent new dual citizen) with a valid job offer under NAFTA agreement. I want to apply for a work permit to canada. I quit my job in late 2017 and obtained a travel visa on another passport (not us citizen at the time). at the time of my arrival to canada in mid 2018 I was pulled aside to secondary. they asked me the purpose of my visit etc, I told them I was on holiday from work even though I was unemployed (out of anxiousness but clearly stupid). they decided to let me through.

My current issue, is that on my application for a work permit, I list the dates of my previous employment which ended in late 2017. I am worried that they will notice I was pulled to secondary on my other passport and informed them that I was on a holiday from work in mid 2018. The dates on my current application contradict what I said in secondary in 2018. and I need to submit my non-american passport as well to the embassy as I need it for proof of residence in my current country, and my previous visits to canada.

will they know what I said in secondary?
can I become inadmissible for misrepresentation in secondary?
is their any course of action for me to take?

*I cross posted this to the temporary US wokers forum, wasnt sure where to put it.

As long as you are honest in your current application - there shouldn't be an issue. It's possible there may be a delay - but this won't result in a misrepresentation finding. Always a very bad idea to lie to immigration officials... Very strongly advise you not do that in the future - regardless of the reason. You could have easily ended up with a 1 year exclusion order at the border last year.

Does it mean that CIC processes each application on it's merits and will not punish you for past misrepresentation which they missed to detect? The person gave false information to CIC which is kept on file. During the processing of a new application, can't the officer punish the person for the wrong information he gave in previous application although the applicant is honest in the current application?

No - this doesn't mean that. Past application information is certainly kept on file and if the misrepresentation is serious enough, it could impact a future application.

For example, if there are significant / material differences between what someone said in their first application vs. a subsequent application (e.g. said they were single when then weren't, lied about where they lived) - that can certainly cause a problem for a future application. Similarly, if someone has been banned from Canada for misrepresentation for five years, any subsequent applications submitted during that five year period will be refused automatically.

So i have an issue like this. I got arrested for a crime I didn't commit in US and when it went to court, it was dismissed. To the best of my knowledge, everything about the case was gone. I applied for Canada visa later and I answered No to that security question regarding whether you have committed a crime before. The issue is, i never even went to court and according to my lawyer, no formal charges were leveled against me. I recently found out that I should have answered yes to that question and explain to CIC what happened. I have applied for 4 different visas and permit and have always answered No to that question. I'm planning to apply for a visa and then tell give CIC that information. Do you think I have a chance of not be banned for misrepresentation?

You should be OK provided you declare this in your next application.

You certainly want to make sure you declare this yourself rather than having IRCC find out on their own when reviewing your new application.

I am planning to add LOE to explain everything in this current application or better still add a letter of apology to draw their attention to it. Do you think that I advisable?
