Passport seized and expired.

I need to renew my spouse passport who claimed refugee.his passport was seized and is expired.Have sponsored him and the cicc need a valid passport aong with his medicals.we cant obtain a new one from his embassy until he provides the old one.does any one know if cbsa can return it before his landing interview?

I had the exactly the same situation. I applied for refugee protection, then later I got sponsored by my wife, they asked me for a valid passport.

I wrote a letter stating that my passport was seized when I entered Canada, and sent a copy of my passport with the letter (via Web Form).

In this case, they will issue you an exemption letter from this requirment & you must bring that letter to your landing interview.

A copy of my passport which was given to me at the entry. You have to state that in the letter (with the stamp).

I had the exactly the same situation. I applied for refugee protection, then later I got sponsored by my wife, they asked me for a valid passport.

I wrote a letter stating that my passport was seized when I entered Canada, and sent a copy of my passport with the letter (via Web Form).

In this case, they will issue you an exemption letter from this requirment & you must bring that letter to your landing interview.

Keep in mind at sponsorship is completely different than refugee program. So it’s handled differently. That means when you go to your landing interview, the officer is going to expect you have a valid passport, show them the exemption letter that they are going to issue it to you, then he/she will request for your passport to be returned to you. That’s what happened in my case at least lol

I believe they will ask him to bring valid passport which he does not have if they approve our sponsorship . I would recommend that you post your question to the Family Sponsorship section of the forum since your question relates to spousal sponsorship. I'm not aware of any alternatives to having a valid passport. To the best of my knowledge, this document is mandatory for spousal sponsorship.

So basically he just need to explain them via IRCC web form and upload his old passport scan? does he needs to do anything else? How long will it take to get that exception letter? When is good time to do this? Before AIP or anytime? And what happens on landing interview? They just grant him PR without passport ? Please little explanation would be perfect..Thanks for your help

Down in the process, they will ask him to provide a valid passport, by then, he must write a letter stating why he doesn’t have his passport and invlude a copy of the original copy they gave him when they seized his passport, with the letter and just upload it through WebForm.

I will share with you the exemption letter they sent me which I had to bring with me to the landing interview to show the officer when she/he asks for my passport. The letter as follows:

This refers to the Application for Permanent Residence you made under the Spouse or

Common-Law Partner in Canada Class.

According to subsection 50(1) of the Immigration and Refugee Protection Regulations, a foreign

national seeking to become a permanent resident must hold

a) a passport, other than a diplomatic, official or similar passport, that was issued by the country of which the foreign national is a citizen or national;

b) a travel document that was issued by the country of which the foreign national is a citizen or national;

c) an identity or travel document that was issued by a country to non-national residents, refugees or stateless persons who are unable to obtain a passport or other travel document from their country of citizenship or nationality or who have no country of citizenship or nationality;

d) a travel document that was issued by the International Committee of the Red Cross in Geneva, Switzerland, to enable and facilitate emigration;

e) a passport or travel document that was issued by the Palestinian Authority;

f) an exit visa that was issued by the Government of the Union of Soviet Socialist Republics to its citizens who were compelled to relinquish their Soviet nationality in order to emigrate from that country;

g) a passport issued by the United Kingdom to a British National (Overseas), as a person born, naturalized or registered in Hong Kong;

h) a passport issued by the Hong Kong Special Administrative Region of the People’s Republic of China; or

i) a passport issued by the United Kingdom to a British Subject.

As per subsection 72(1)(e)(ii) of the Regulations, a foreign national in Canada becomes a permanent resident if, following an examination, it is established that except in the case of a foreign national who has submitted a document accepted under subsection 178(2) or of a member of the protected temporary residents class, they hold a document described in any of paragraphs 50(1)(a) to (h).

Thank you very much for this information. So what i understand is they granted you without valid passport right? Down in the process meaning they grant you without passport but you need passport to travel -(obviously) or they ask you to bring valid passport after you get PR as well? I know I'm asking many too many questions please understand that we're in so much stress ...

Yes they granted me PR without a valid passport, now that I am a PR, I applied for a Refugee Travel Document (RTD) and they issued me that without any problems, I have RTD valid for 5 years.

*I forgot to tell you something, if he was accepted as a protected person, he should include his Notice of Decision with the letter he will write besides the copy of his seized passport.

Yes they granted me PR without a valid passport, now that I am a PR, I applied for a Refugee Travel Document (RTD) and they issued me that without any problems, I have RTD valid for 5 years.

*I forgot to tell you something, if he was accepted as a protected person, he should include his Notice of Decision with the letter he will write besides the copy of his seized passport.
No he wasn't accepted at all. He is rejected refugee claimant and out of status for 3 years. I recently sponsored him. So when should he write to the IRCC? Is it better to do it now or wait for the approval AIP ? And how long it took you to get that letter/email from IRCC ?
