Husband denied visa to Canada

I met my husband in the Dominican Republic in March of 2015. We got married 13 months later. July of 2017, I filed for spousal sponsorship. We had our interview in June/2018. My husband was asked a lot of questions about me to which he answered as best as possible. However he forgot the names of my parents, my father passed away before we met and my mother lives in Australia so he never met her either. Although he answered about my parents whereabouts he just couldn’t remember their ethnic names. In my culture we do not refer to our parents by name so he wasn’t use to hearing their names. Also I had a spontaneous miscarriage to which he couldn’t remember the exact date. For this reason the officer said he is not genuine and denied his visa. She was Mexican and she kept asking him why he couldn’t find a Dominican woman and what was wrong with them that he found a foreigner. Everyone has the right to fall in love with whoever they want. Anyway I appealed the decision and submitted all the supporting documents and letters from my mom and brothers and family and friends. Immigration still didn’t accept and now wants a full appeal trial. I can’t afford to pay all this money. Immigration has made me broke with all this back and forth paperwork and lawyers fees. Also I was asked to attend the interview so I took time off from work and went to DR. The officer didn’t even interview me. She just dismissed my husband. She didn’t give us procedural fairness. Then the next day after the interview we get a invitation to Canada letter. Welcoming my husband and giving him links for free prearrival services. We started sharing the good news only to find another letter a week later that denied his visa. This has been the most horrible experience. I’m a single mother. Hardworking and he is also a single dad, works full time, supports his kids and owns his house. The officer said he is not established in his country. She seemed like a prejudice officer because she clearly had it in her to attack him and didn’t look at all the supporting documents. His house is 3 bedroom modern design and he has no debts. He is a genuine man. Doesn’t have a secondary school diploma but is hard working and has always been employed. My MP is not responding to my cry for help. I don’t know what to do? Please if if anyone has any advice. I wanted to apply for a visitors visa but my lawyer said he won’t get it because of what happened. I miss him so much and just want us to be together. I feel it is unfair. We have refugees coming here with zero problems like this. I have been living and contributing to this economy for over 30 years. Why is this happening to me??

Don't apply for a visitor visa. It's guaranteed to be refused.

If you aren't able to go further in the appeals process, then your only option is to reapply. I would wait until you have stronger evidence / have addressed the refusal reasons before you reapply. It's difficult to say what you need to address without knowing the full details of your case or what your GCMS notes say.

If someone fails an interview, the application is typically refused without a procedural fairness letter. So it makes sense that no procedural fairness letter was received.

An MP cannot change an immigration application decision and can't help your case.

Thank you. We did. I have the report but she only mentioned what he couldn’t answer. And a few questions that were correct but the transcript is incomplete.

I have my kids here and they’re still young and needs their mother. I can’t leave them and go live in DR. We are keeping that house for our retirement. I wish it was that easy of a decision because believe me I did think about it.
You’re reading too much into what I said in the end. I never said what you’re inplying. The process is so time consuming and costly. I have to pay another $5,000 plus wait maximum of 2 years for this appeal trial. It is frustrating.

Don't apply for a visitor visa. It's guaranteed to be refused.

I am so sorry to hear this. It is unbelievable that your husband was denied visa just because he could not remember your parents' name? Are you sure about this? There must be some other things along with this to make immigration officer to be suspicious about your relationship.

And at this difficult time, I think it is economically wise to reapply instead of spending huge amount of money and time waiting for appeal. I know, it is not fair.

Also she had mentioned that he is not established in DR. He has a full time job, works 16 hour days and going back ten years, he was always employed. He owns his house, no bank loans, no criminal history. Nothing!! This officer questioned why he couldn’t meet a Dominican woman? What was wrong with them? My husband said nothing was wrong, I did date but it didn’t work out. When I met my wife, I just knew we were meant for each other. I felt the same way too. I have travelled a lot and NEVER imagined having a long distance relationship.

Unfortunately, I am afraid there are not many options for you at this point. If you fight for it, you are going to fight the whole system. Taking from a different perspective, it is not the end of the world. It just means you have to extend dating with your husband a little longer and reapply for reunion at a later date. I hope your lawyer or other senior members here could provide more help on this tragedy.

Thank you. The three reasons were my mom’s name, my dad’s name and the date of the miscarriage. My lawyer suggested to cancel the appeal trial and start a new application and address all the concerns from previous application.

I think it is a good idea. Do you know how long you have to wait to re-apply? I hope your husband can come to Canada to union with you soon!

The application itself will take 12 months once we file it. Now I need to pay again and collect all the documents for new application. Not only time consuming but expensive. Trying to stay positive and trusting in god to help us through this process. That’s all we can do. E

Oh my this is devastating, I am so sorry you are going through this. But remain positive, start with a new application with additional and new evidence, and prepare your hubby in advance should he have to go through another interview.
